312 John Tunstall of a plea of Trespass upon the Case &c And Whereupon the Same John Tunstall by Robt Jenkins Henry his attorney Complains that whereas the said Hugh Arbuthnott in his Lifetime to the aforesaid John Tunstall to Witt on the Tenth day of August one thousand seven hundred and thirty one at Somrst County within the Jurrisdiction of this Court was Indebted unto the aforesaid John Tunstall in the Sum of Eighteen pounds Nineteen Shills and Eleven pence Sterl mony of Great Brittain for Service done by the Said John for the Said Hugh in his Lifetime and at the Special Instance & Request as by Acc.o hereunto Annexed may in Court appear and so thereof being Indebted the said Hugh in his Life time afterwards to witt the same day and year afsd at the County afs.d within the aforesaid Jurrisdiction aforesaid in Consideration thereof upon himself did Assume and to the said John Tunstall then and there faithfully Promised that he the Said Hugh the Said Eighteen pounds Nineteen Shills and Eleven ^pence^ Sterl mony to the said John well and faithfully would pay and Content when afterwards he should be thereunto Required Nevertheless the said Hugh in his Life and the said Nathl Foche James Pierce and John Wood after the Death of the said Hugh the Promise and Assumption of the Said Hugh so as aforesaid in his Life time made no ways Regarding but Designing and fraudulently Intending him the Said John to deceive and Defraud the Said Eighteen pounds Nineteen Shills and Eleven pence Sterl or any part thereof to the Said John hath not paid or Satisfyed altho this to do the said Hugh in his Lifetime and the said Nathl James and John Since the Death of the Said Hugh by the Said John to Witt the fifth day of September and year aforesaid at Somerset County afs.d within the Jurr afs.d was Required but the Same to the Same John to pay the Said Hugh in his Life and the afs.d Nathl James and John Since his Death have altogether Refused and Still doth Refuse to the Damage of the said John of thirty Eight pounds Like mony and thence he brings Suit &c Pledges &c Jno Doe & Rich.d Roe
Att which said Third Tuesday of March to witt the Twentieth day of the Same Month Anno Dom one thousand seven hundred and thirty two Came the said John Tunstall by his Attorney afsd and the Sher of Somerset County to whome the aforegoing Writt was Directed Likewise Cometh and Maketh Return thereof to the Cort here Endorsed in these words following vizt (Non) |
