June Court               1733                   312

Att which said Next Court to Witt Twentieth day of June Anno Dom one thousand seven hundred
and thirty three Came againe the said Isaac Atkinson by his Attorney afs.d and thereupon the said
Patrick Connelly being Called appears and thereupon the said Patrick Connelly at the prayer of the afd Isaac
Atkinson by his attorney afd is adjudged to give Speciall Bail to the action afd but for want thereof the said
Patrick Connelly is Committed into the Custody of the sher of Somerset County there to Remaine &c the said sher
to witt Joshua Caldwell Gent present herein Court took Charge of the said Patrick Connelly accordingly &c

       And afterwards the Said Patrick Connelly in Custody as afd present herein Court defends the force and Injury
when &c and Saith that he Cannot Gainsay the ^action^ afd of the afd Isaac nor Can he say but that he did assume
upon himself in Manner and form as the afsd Isaac Above against him hath Complained and
as to the damage of the said Isaac by him by Occasion of the Premises in that part sustained the
same Patrick says and Confesseth that the afs.d Isaac has sustained Damages by occasion of the
premises further then this Costs and Charges by him about his suit in that part apposed to Nine
hundred pounds of Pork and not more and because the aforesd Isaac denys not this but the
Same Allegation Confesseth to be True prays Judgm.t for those Damages above Confessed
and his Costs and Charges afsd to him adjudged &c
                                                                               Therefore by Consent of the parties afsd
it is Considered that the afsd Isaac Atkinson Recover against the afsd Patrick Connelly
his damages afsd to the afsd Nine hundred pounds of pork by the same Patrick in form afsd
Confesed as also Two hundred and Eighty four pounds of Tob.o for his Costs and Charges afsd
to the same Isaac at his Request by the Court here and Consent of the parties afsd Adjudged
And the afsd Patrick in Mercy &c          Whereupon the Said Patrick Connelly present herein
Court in his proper person is at the prayer of the afd Isaac Atkinson by his attorney afd Committed
into the Custody of the sher of Somerset County there to remain untill the said Isaac of his damages afd should
be fully satisfied the said sher to witt Joshua Caldwell Gent present herein Court took Charge of the said
Patrick Connelly accordingly &c

   Command was given tot he sher of Somerset County that
he should take Nathaniel Foche James Peirce and John
Wood late of Somerset County Merchts Adm.rs of all and Singular
the Goods and Chattles Rights and Credits which were of Hugh
Arbuthnott Late of London Merchant Decd if they should be
found in his Balywick and them should safe keep so that he might have their Bodys before the
Justices of his Lordships County Court of Somerset to be held at Dividing Creek the third Tuesday of
March next to Answer unto John Tunstall of a plea of Trespass upon the Case &c    And that
thereof he should not fail &c
                                     And the aforesaid John Tunstall by Rob.t Jenkins Henry his
Attorney Complains against the said Nath.l James and John in the plea afsd as followeth vizt
Somerset ss    Nathaniel Foche Jame Peirce and John Wood Late of Sommerset County Merch.ts
                      and Admrs of all and singular the goods and Chattles Rights and Credits which were of
                      Hugh Arbuthnot Late of London Mercht dec.d were Attached to answer unto
