312 Non Est Inventus Short note Left p Joshua Caldwell sher Att which Day the plea afsd with all things thereunto Relating was by Act of Assembly and the Court Adjourned untill next Court to be held at Dividing Creek the third Tuesday of June Next &c Att which said next Court to witt the Ninteenth day of June anno Dom One thousand Seven hundred and thirty three Came againe the said John Tunstall by his attorney afd and Whereupon the said John Prays that forasmuch as he has Complyed with the Law as all in order to an Attachment he may have Judgm.t against the said Nathaniel Foche, James Peirce and John Wood admrs as afd for his damages afd by way of attachment according to Act of Assembly &c whereupon for that it seems to the Court here that the afd John Tunstall hath Complyed with the Law as alledged &c Therefore it is Considered by the Court here that the afd John Tunstall Recover against the afd Nathaniel Foche, James Peirce and John Wood adm.rs of the afd Hugh Arbuthnot dec.d his damages afd to the afd Eighteen pounds Ninteen shillings and Eleven pence sterling money of Great brittaine as also 331 all Costs and Charges by the said plft Laid Out and Expended by way of attachment against the goods Chattells Rights or Creditts of the afd Hugh Arbuthnot dec.d (at the time of his death Remaining to be administred) according to act of assembly in Such Case made and provided &c |
