third Tuesday of March then Next to Answer unto Isaac Atkinson of a plea of Trespass upon the Case &c And that thereof he should not fail &c And the said Isaac Atkinson by Francis Allen his Attorney Complains against the said Patrick Connely in the plea aforesaid as followeth viz.t Somerset County ss Patrick Connely late of Somerset County felt maker was Attached to Answer unto Isaac Atkinson of a plea of Trespass upon the Case &c And Whereupon the said Isaac by Francis Allen his Attorney Complains that Whereas the Said Patrick the twenty Ninth day of August Anno Dom Seventeen hundred and Thirty two at Somerset County within the Jurisdiction of this Cor.t was Indebted unto the said Isaac in the Quantity of Nine hundred pounds of good pork for three Beaver Hatts by the said Isaac to the said Patrick before that Time there sold and delivered as by Acc.t thereof Ready here in Court to be Produced and hereunto Annexed may Appear And being so thereof Indebted the said Patrick in Consideration thereof the day and year aforesaid at the place aforesd upon himself did Assume and to the said Isaac then and there did faithfully promise that he the said Patrick the said Nine hundred pounds of Good Pork to the said Isaac when he Should be thereunto Requested he would well & faithfully pay and Content Nevertheless the said Patrick his Promise and Assumption aforesaid Informe aforesaid made Nothing Regarding but plotting and fraudulently Intending the said Isaac in that part Craftily and Subtily to deceive and defraud the said Nine hundred pounds of Good pork to the said Isaac altho the same to do the said Patrick by the said Isaac on the Twentieth day of November in the year aforesaid and often afterwards at the County afs.d within the Jurrisdiction afores.d he was thereunto Requested hath not paid or Contented but the same to him hitherto to pay or Content hath Refused and still doth refuse and Deny to the Damage of the said Isaac of Tenn pounds Curr.t mony of Maryland And thereupon he brings suit &c Pledges de proq Jno Doe & Richd Roe Aug.st the 29/1732 Patrick Conole D.r to be paid at Patience Atkinsons house To 3 beafer hats at three hundred pound of good pork pr hatt 900ll Isaac Atkinson March ye 5.th 1732 Then Came before me the Subscriber one of his Lordships Justices of the peace Isaac Atkinson & Made Oath upon the Holy Evangelist of Almighty God that the within Acc.o is Just and True & that he hath Recd no part nor parcell of the same nor any Security nor Satisffaction for the Same Sworn to before me Jn.o Scott A Copy of the foregoing Declaration and Account were made and sent to be served on the Defendant with the Writt in the plea aforesa'd &c Att which said third Tuesday of March to Witt the Twentieth day of the Same Month Anno Dom one thousand Seven hundred and thirty two Came the Said Isaac Atkinson by His Attorney afores.d and the Sher of Somerset County to whom the Aforegoing Writt was Directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these Words following viz.t Cepi Corpus declaration delivered in time p John Caldwell sher Att which day the plea aforesaid with all things thereunto Relating was by Act of Assembly and the Court Adjourned untill next Court to be held at Dividing Creek the third Tuesday of June next &c att |
