        unto the aforesaid Levin George John and Mathias in the aforesaid Sum of Sixty pounds Curr
        Money of Maryland to be paid to the Same Levin George John and Mathias when thereof afterwards
        he should be Required  Nevertheless the aforesaid Hugh the Testator in his Life time and the
        aforesaid Mary since the Death of the Same Hugh the Testator altho often required the
        aforesaid sixty pounds unto the the afs.d Levin George John & Mathias or to any or Either
        of them yet have not paid nor hath Either of them Paid but the Same to them to pay the aforesd
        Hugh the Testator in his Lifetime and the afores.d Mary since the Death of the same Hugh
        the Testator altogether have Refused & the aforesaid Mary Still doth Refuse and Unjustly
        Detain to the Damage of the Same Levin George John and Mathias Ninety pounds
        Currt mony and thereof they bring suit &c and bring into Cort the writing afores.d which the
        Debt aforesaid in form afores.d testifies whose date is the same Day and Year afsd

        A Copy of the aforegoing Declaration was made and sent to be served ^on ye Deft^ with the Writt in the plea
        afsd &c             Att which said third Tuesday of March to witt the twentieth day of the Same Month
       Anno Dom one thousand seven hundred and thirty two Came the Said Levin Gale George Gale John
       Gale and Mathias Gale by their Att.ry afs.d  and the sher of Somerset County to whom the aforegoing
       Writt was Directed Likewise Cometh and Maketh Return thereof ^to the Court^ here in those words following vizt
       Cepi Corpus Declaration delivered in Time p Joshua Caldwell sherr

       Att which day the plea afsd with all things thereunto Relating was by Act of Assembly and the Court
       Adjourned untill next Court to be held at Dividing Creek the third Tuesday of June Next &c

Att which said next Court to witt the Twentieth day of June anno Dom One thousand Seven hundred and thirty three Came
againe the said Levin Gale, George Gale John Gale and Mathias Gale by their attorney afd and the Said Mary Porter
Executrix as afd by Francis Allen her attorney afd Comes and defends the force and Injury when &c and Saith that she
Cannot Gainsay the action afd of the afd Levin, George, John and Mathias Gales nor Can she say but that the
writing Obligatory afd is the deed of the Same Hugh nor but that she detaines from the afd Levin, George John and
Mathias Gales the afd Sixty pounds Currant Money in Manner and form as the afd Levin George John and Mathias
Gales above against her hath declared &c

                   Therefore it is Considered that the afd Levin Gale G^e^orge Gale and John Gale and Mathias
Gale Recover against the afd Mary Porter Executrix as afd their debt afd and their damages by Occasion of
378    the detaining of the Same debt to three hundred & Seventy Eight                        pounds of tobacco of
their assent by the Court here adjudged of the goods and Chattells which were of the afd Hugh Porter at the time of
his death in the hands of the afd Mary Remaining to be administred if so much in her hands she hath and if
so much in her hands she hath not then the damages afd to be Levied of the proper goods and Chattells of the afd
Mary and ye deft in mercy &c

Cluff late of Somerset County Blacksmith als Dict Edw.d Cluff of Somerset County
in the Province of Maryland Blacksmith if he should be found in his balywick
and him should safe keep so that he might have his Body before the Justices of his Lordships
