310 Said Thomas of sixty pounds mony aforesaid and thereupon he brings Suite &c Pledges de proq John Doe & R Roe And the said Isacher Wilcox in his Own proper person Comes and defends the force and Injury when &c and Saith that he Cannot gainsay the action afd of the afd Thomas nor Can he Say but that he did assume upon himselfe in manner and form as the afd Thomas above against him hath Complained and as to the damage of the said Thomas by him by occasion of the premisses in that part sustained the same Isacher says and Confesseth that the afd Thomas has Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to fifty Nine pounds ten shillings Curr money of Maryland and not more and because the afd Thomas Denys not this but the same allegation Confesseth to be true prays Judgmt for the damages above Confessed and his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties afd it is Considered that the afd Thomas Fletcher recover against the afd Isacher Wilcox his damages afd to the afd fifty Nine pounds ten shillings Currant Money of Maryland 309 by the same Isacher in form afd Confessed as also three hundred & Nine pounds of tobacco for his Costs and Charges afd to the Same Thomas at his request by the Court here and Consent of the parties afd adjudged and the afd Isacher in Mercy &c
before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of march then next to answer unto Levin Gale George, John Gale and Mathias Gale of a plea that she render unto them the Sum of sixty pounds Currant Money of Maryland which from them she unjustly detaineth &c and that thereof he should not fail &c And the said Coll Levin Gale George Gale John Gale and Mathias Gale by Wm Beckingham their Attorney ^afd^ declareth against the said Mary Porter in the plea aforesaid followeth vizt Somerset County ss Mary Porter late of Somerset County Widow Executrix of the Testament and last will of Hugh Porter late of Somerset County Planter deceased otherwise lately Called Hugh Porter late of Somerset County was sumoned to answer unto Levin Gale George Gale John Gale and Mathias Gale of a plea that she Render unto them the sum of sixty pounds Currt mony of Maryland which from when she Unjustly Detaineth &c And Whereupon the same Levin George John and Mathias by W.m Beckingham their Attorney Say that whereas the afs.d Hugh in his Life time to witt the Ninth the Day of October Anno Dom Seventeen hundred and thirty one at Somerset County by his Certain Writing Obligatory had Granted himself to be held and firmly bound (unto) |
