1733 305 and the said Edward Chambers Esqr for the Cause afd should not Remain forfeited that he should ^come^ forth & be heard and none so to do appear It is agreed that Joshua Caldwell sher of Somerset County be Commanded by writt of the Lord propry that now is under the seal of this Court the said vessell or Shallop together with her Tackle apparell and furniture three hoggs of Tobacco three deer skins & one Skillett by the Oath of good and Lawfull men of the said County Justly and faithfully to Cause to be appraised making an Indenture thereof between him and the said appraisers &c so that one part of the said Indenture he have here Immediately during the Sitting of this Court at dividing Creek &c And now hereafterwards during the sitting of the Court the said sherr Returns here the writt afd together with a Certain Indenture to the Same writt annext of which Indenture the tenor is as followeth viz.t This Indenture made the twenty first day of June one thousand seven hundred and thirty three &c Wittnesseth that we James Jones and John Murray appraisers according to a writt to the sher of Somerset County directed and hereunto annext have viewed and appraised the vessell or shallop Called the Somerset together with her Tackle apparell and furniture three hogsheads of tobacco three deer skins and one skillet at the Sum of Twenty four pounds Ninteen shillings and Six pence Curr money In wittness whereof we have hereunto set our hands and Seals the day and Year above written Upon which was further proclamation made for the said Lord the King (as the manner is) that if any person would Inform the Court here wherefore the said vessell or shallop Tackle apparell and furniture three hogsheads of tobacco three deer Skins and One Skillet than the appraisment he should Come forth and be heard but none so doing Therefore it is Considered by the Court here that the said Vessell or shallop with her Tackle apparell and furniture three hogsheads of tobacco three deer skins and one skillet Remain forfeited for the Cause afd and that the Lord the King that now is have one third part thereof that the said Lord propry have one third part thereof and that the said Edward Chambers Esqr have the other third part thereof &c
Lord Prop.ry in this part prosecutes and Gives the Said Court to Understand and be Informed that Elias Beavans of Som.rst County Plant.r the Twentieth day of June in the Year of our Lord one thousand seven hundred d thirty three at the County afsd and within the Jurisdiction of this Court with force and Arms &c in and Upon a Certain Jonathan |
