303 him supposed whereupon all and Singular the premises by the Court here seen heard and fully understood &c It is Considered by the Court here that the afd Thomas Vance pay to his Lordship the Right honrble the Lord proprietary Six hundred pounds of tobacco for his fine by Occasion of the premisses upon him Imposed and that the same Thomas be taken to Satisfie his said Lordship of the fine afd thereupon the said Thomas Vance is ordered to give Security for the fine afd and the Severall Officers Fees due by Occasion of the premisses afd thereupon a Certain David Vance of Somerset County planter present here in Court undertakes for the said Thomas Vance for to pay the fine afd and the Severall Officers Fees due by means of the premisses afd &c
and thirty two with force and armes &c at the County of Somerset afd and within the Jurisdiction of this Court in and upon a Certain Patrick Dailey in the peace of God and of the afd Lord Proprietary then and there being an assault did make and him then and there did beat would and Evilly Intreate so that of his Life it was greatly despaired and other harms to him then and there offered to the grevious damage of him the said Patrick and against the peace of the right honrble the Lord Proprietary &c Test Pat Daley on the backside of the foregoeing Bill of Indictment it was Endorsed vizt Bella Vera Jno Donelson Foreman Thereupon Command was given to the sher of Somerset County that he should take the said Edward Harper if &c to answer &c and afterwards in the same Court to witt the Ninteenth day of June ann.o Dom One thousand Seven hundred and thirty three before the Justices of the Same Court Came the afd Edward Harper in his proper person and had a hearing of the Indictment afd and being Instantly demanded how he would acquitt himselfe of the premisses afd ^above by the Indictm.t afd upon him Imposed^ says that of the premisses afd above by the Indictment afd upon him Imposed he is not Guilty thereof and of this he putts himself upon the Country and Robert Jenckins Henry Gent attorney of his said Lordship the Lord proprietary who for his said Lordship in that part followeth likewise &c There^upon^ Command is given to the sher of Somerset County that Immediately he Cause to Come here twelve &c and who neither &c to Recognize &c because as well &c and now hereafterwards to witt the Same day and Year Cometh thereof the Jurors of that Same Jury by Joshua Caldwell Gent sher of the County ^afd^ to this Impannelled being Called Came to witt William Handy, John Scarbrough Michael Disharoon Parker Selby, John Webb Edward Beahamp, Joshua Sturges, Abraham Smith John Johnson William White, David Hazzard and Dennis Driskil who to say the truth of the premises being Elected tryed and Sworn upon their Oath did say that the afd Edward Harper is not guilty of the trespass and assault as by the Indictment afd specified in manner and form as by the Indictment afd above against him Supposed whereupon all and Singular the premisses by the Court here seen heard and fully understood It is Considered by |
