300 time past and have passed too and from it with Our Creatures without Interuption or danger but there is on our Road a ditch which was Formerly Cutt by One Thomas Fenwick who was formerly an Inhabitant of this County which said ditch was Cutt from Out of Assawaman sound to the head of Synapuckson bay or sound a Cross our Road which said Road was of Long Standing before the said ditch was ever made and now of Late Years through the force and violent of water through the said ditch it is worn to that degree both in wedth and depth that we Cannot pass over with our Creatures to Our Marshes nor ^from^ them without great danger both of Our Creatures and much more of our Lives which danger and trouble we are willing to prevent by making Our Selves away over the said ditch if we Could have the Liberty but Capt William Fasitt having a pretention to the Marsh where the ditch is refuseth to give us Liberty to dam or Stop the said ditch we therefore your petitioners most humbly pray that your worships would take it into your Consideration and help us from this burden we Labour under and give us an Order to have the Liberty to keep Our Road that we have had the benefitt of ever since the upper parts of the Sea side hath been Indebted which wee think not Less then Fifty Years agoe or otherwise we must of the Necessity be deprived of the benefitt of Our Interest which we hope your worships will do and your petitioners as in duty bound shall ever pray &c Edmond Hough, Eliza Davis, Richard Hickman, John Evans, Ebenezer Evans, William Waltom, W.m Woodcraft John Collins, Richard Wood Craft William Simpson John Purnall & the rest &c The petition afd being Read and heard and fully understood and mature deliberation thereupon &c Wherefore it is Considered by the Justices here that the petitioners afd stop and dam the ditch afd in the petition afd mentioned and that the Road mentioned in the petition afd Leading on the beaches be and remain a road unalterable (by any person or persons ^whatsoever^ untill further orders) as by the petition afd is praid &c
take the said Sarah Gorde if she should be found in his bailywick and her should Safe Keep so that he might have ^her^ here to answer &c and afterwards in the Same Court Came the Said Sarah Gorde in Custody of the sher and being set to the barr is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd Says that of the premisses afd above upon her Imposed she is Guilty thereof and makes Oath that a Certain Thomas Vance is the begetter of the Child she stands presented for but hath nothing to pay her fine for the fact afd &c Therefore it is Considered by the Court here that the said Sarah Gorde be whipt at the publick whiping post with twenty Lashes well Laid on untill the Blood appear and that she be taken &c thereupon |
