November Court 1730
29 Thereupon Command was Given to the Sherr of Somerset County that he Should take the Said William Stoughton if &.c to answer &c and afterwards to witt the seventeenth day of November anno Dom One thousand Seven hundred and thirty being the same day came hereinto Court the aforesaid William Stoughton in his proper person and being by the Sher set to the barr is thereupon Instantly demanded how he would acquitt himselfe of the premisses in the Indictment aforesaid above upon him Imposed saith that he Cannot deny but that he is Guilty of the trespass and assault afd above specified in manner and form as by the Indictment aforesaid above supposed Therefore it is Considered by the Court here that the aforesaid William Stoughton pay unto his said Lordship the Lord propry for his fine by the Court hereupon him Imposed for and by Occasion of the trespass and assault aforesaid whereof ^in form afd^ he is Convict the sum of four hundred pounds of tobacco and that the same Wm Stoughton be taken to satisfie his said Lordship of the fine afd &c James Robinson appears according to his Recognizance entered into for his appearance at this Court & is discharged &.c Edward Chambers and Patrick Lackey appears according to his their Recognizance and are discharged &c
Smith is ^adjudged to^ Give Speciall bail to the action aforesaid thereupon a Certain Thomas Lambden of Somerset County Gent.m undertak present here in Court in his proper person undertakes for the Said William Smith that if in Case the Said Moses Chaille shall Recover Judgmt in the plea aforesaid against the Said William Smith or that the said William Smith shall be therein Convict that then he the Said Wm Smith Shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that he the Said Thomas Lambden will do it for him thereupon the said William Smith by Levin Gale his attorney appears & Imparls till next Court &c
Jurisdiction of this Court was Indebted unto him the said Francis in four hundred and forty six pounds of tobacco as by an account hereunto annexed may in court appear and being so thereof Indebted the said Joshua in Consideration thereof the day and Year aforesaid at the County aforesaid within the Jurisdiction aforesaid upon himselfe did assume and to the said Francis then and there did faithfully promise that he the said Joshua the aforesaid four hundred and forty Six pounds of tobacco when he Should be thereunto requested he would well and faithfully pay and Content nevertheless the Said Joshua his promise and assumption aforesaid in form aforesaid Made nothing regarding but plotting and fraudulently Intending the Said Francis in that part Craftilly and Subtilly to deceive and defr defraud the said four hundred and forty Six pounds of tobacco to the Said francis alho' the same to do the said Joshua by the Said francis on the aforesaid first day of august in the Year aforesaid and often afterwards at the the County aforesaid within the Jurisdiction aforesaid Francis he was thereunto required hath not paid or to him for the Same in any sort Contented but the Same to him hitherto to pay hath refused and Still doth refuse |
