288 and unjustly detaineth &c and that thereof he should not fail &c Att which said third tuesday of March to witt the twenty first day of the same month anno Dom One thousand Seven hundred and thirty One being the day of the Returne of the said Writt Cometh the said John Tunstall by Levin Gale his attorney and the sher of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words vizt Cepi Corpus P Jos.a Caldwell sher Whereupon the said Thomas Fletcher being Called appears and thereupon the said Thomas Fletcher at the prayer of the aforesaid John Tunstall by his attorney afd is adjudged to give speciall bail to the action aforesaid thereupon a Certain Thomas Lambden and John Murray both of Somerset County planters present herein Court in their proper persons undertook for the said Thomas Fletcher that if in Case the said John Tunstall Should Recover Judgment in the plea aforesaid against the Said Thomas Fletcher or that the said Thomas Fletcher should be therein Convict that then he the Said Thomas Fletcher should pay the Condemnation of the Court thereupon or render his body to the Custody of the sheriffe of Somerset County in Satisfaction thereof that they the Said Thomas Lambden and John Murray will do the Same for him &c Whereupon the said Thomas Fletcher by William Beckingham his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereun untill next Court and he hath it and the same day is Given to the aforesaid John here also &c Att which said next Court to witt the twentieth day of June ann.o Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesaid Thomas Fletcher by their attorneys afd and thereupon the same Thomas Fletcher prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day and Given to the afd John here also &c Att which said next Court to witt the fifteenth day of august Ann.o Dom One thousand Seven hundred & thirty two Came againe as well the aforesaid John Tunstall as the aforesaid Thomas Fletcher by their attorneys afd and thereupon the same Thomas Fletcher prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the aforesaid John here also &c Att which said next Court to witt the twenty first day of November Ann.o Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesaid Thomas Fletcher by their attorneys afd and thereupon the same Thomas Fletcher prays Further Leave thereof to Imparle here untill next Court and he hath it and the Same days given to the afd John here also &c Att which said next Court to witt the twentieth day of March Anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesaid Thomas Fletcher by their attorneys afd and thereupon his Lordship the Right honrble the Lord Proprietary his Certain writt of Habeas Corpus unto the Justices of his County Court of Somerset afd now here sendeth which said writt followeth in these words viz.t Maryland ss Charles absolute Lord and propry of the Provinces of Maryland and avalon Lord Baron of Bal.t &c To the Justices and Sheriffe of Somerset County Court Greeting Whereas a Certain Thomas Fletcher of the Same County Clerk is detained in the prison of Our said County under the Custody of you our said sheriffe at the suit of a Certain John Tunstall assignee of Hugh Porter in a plea of debt which said plea as it is said still depends before |
