287 said John Finch shall make Restitution unto the said John Goldsmith of all or such part ^therein^ as shall be appear to be undue &c or that he the Said W.m Stoughton will do it for him &c Therefore it is Considered by the Justices here that the Severall Goods and Chattells so as afd attached and appraised to the value of Eight pounds Ninteen shillings and five pence be Condemned as the Goods and Chattells of the afd John Goldsmith towards Satisfying unto the Said John Finch his damages and all Costs accrewing by means of the writt of attachment aforesaid and that the said John Finch have thereof Execution &c
Court of Somerset to be held at dividing Creek the third tuesday of March then next to answer unto John Tunstall assignee of Hugh Porter according to act of assembly in such Case provided of a plea that he Render unto him Sixty pounds Sterling which to him he Oweth and unjustly detaineth &c and that thereof he should not fail &c Att which said third tuesday of March to witt the twenty first day of the Same month anno Dom One thousand Seven hundred and thirty One being the day of the Return of the said writt Cometh the Said John Tunstall by Levin Gale his attorney and the sherr of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words viz.t Cepi Corpus P Jos.as Caldwell sher Whereupon the said Patrick Connelly being ^Called^ appears and thereupon the said Patrick Connelly at the prayer of the aforesaid John Tunstall by his attorney aforesaid is adjudged to Give Speciall bail to the action aforesaid ^in the plea afd^ thereupon a Certain Thomas Fletcher of Somerset County Gentleman present here in Court ^in his proper person^ undertakes for the said Patrick Connelly that in Case the said John Tunstall should recover Judgmt in the plea aforesaid against the said Patrick Connelly or that the said Patrick Connelly shall be therein Convict that then he the said Patrick Connelly shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said Thomas Fletcher will do the same for him &c Whereupon the said Patrick Connelly by William Beckingham his attorney Comes and defends the Force and Injury when &c and prays Leave thereof to Imparle here untill next court and he hath it and the same day is Given to the afd John here also &c Att which said next Court to witt the twentieth day of June ann.o Dom One thousand Seven hundred & thirty two Came againe as well the afd John Tunstall as the afd Patrick Connelly by their attorneys afd and thereupon the same Patrick prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the aforesaid John here also &c Att which said next Court to witt the fifteenth day of august anno Dom One thousand seven hundred and thirty two Came againe as well the afd John Tunstall as the afd Patrick Connelly by their attry afd |
