1732 282 Court and for as much as nothing was Objected against to Continue him bound therefore he and his Security were accordingly discharged &c James West and Mary West appears here in Court according to their Recognizance taken before Mr John Handy one of his Lordships Justices of the peace for Somerset County for their good behaviours and appearance at this Court and forasmuch as nothing appeared to the Court to Continue them bound therefore they and their Securitys were accordingly discharged &c Anthony West appears according to his Recognizance Entered into before Majr Robert King one of his Lordships Justices of the peace for Somerset County for his good behaviour and appearance at this Court and forasmuch as nothing was Objected against him to Continue him bound therefore he and his Security were accordingly discharged Capell King appears herein Court in his proper person according to a Certain Recognizance for the good behaviour and Nothing being Objected against him to Continue him bound therefore he and his Security were accordingly discharged Dewer Litefoot appears according to his Recognizance for his good behaviour and appearance at this Court and nothing being Objected against him to Continue him bound therefore he and his Security were accordingly discharged &c
and be informed that Richard Driskill Late of Somerset County planter the aforesaid twentieth day of march in the Year aforesaid and within the Jurisdiction of this Court and at the County aforesaid with force & Armes &c in and upon a Certain James Shirley in the peace of God and the afd Lord proprietary then & there being an assault did make and him did beat wound and Evilly Entreat so that of his Life it was Greatly despaired and Other harms to him then and there did do to his great damage and against the Peace of the Right honrble the Lord Proprietary his good rule and Government whereof the Same Rob.t Jenckins Henry for the said Lord Proprietary prays advisement of the Court and that due process of Law against the said Richard Driskill may Issue And afterwards here to witt the twentieth day of March one thousand Seven hundred and thirty two before his Lordships Justices (at dividing Creek in Somerset County) on Court Judicially Sitting Came the afd Richard Driskill in his proper person under Custody of the Sherr of Somerset County to witt Joshua Caldwell Gent and hath a hearing of the Information aforesaid and Says that he is not thereof Guilty and of this he putts himselfe upon the County and Robert Jenckins Henry ^who^ for his said Lordship in this part follows Likewise &c Thereupon Command is Given to the sher of Somerset County that Immediately he Cause to Come here before the aforesaid Justices twelve &c by whom &c and who neither &c to Recognize &c because as &c and the Jurors of that Same Jury by Joshua Caldwell Gent she of the County afd to this being Impannelled who were Called ^did^ Come to witt John Scarbrough W.m White, David Polke George Benston, Thomas Reiley John Lane Abraham Owten, Thomas Peal, W.m Collin, Angello Atkinson John Sturges and John Hall who to say the truth |
