truth of and upon the premises being Elected tryed and Sworn and for as much as it did appear as well
to the Justices afd as to the afd Robert Jenkins Henry ^who for his said Lordship in this behalfe prosecutes^ upon Evidence that the afd Richard Driskill had
Committed a robbery upon a Certain James Shirley &c    thereupon Thomas Peal One of the Jurors aforesaid
Impannelled and Sworn by the Comand of the Justices aforesaid (and of the Consent of the afd Robert
Jenckins Henry who in this part prosecutes) is withdrawn and the Rest of the Same Jurors Sworn of their
Verdict of and upon the premises aforesaid to render are fully discharged &c    Whereupon
[illegible] is ordered by the Court here that the aforesaid Richard Driskill Give Security for his good
behaviour and appearance before his Lordships Justices of the Next assize nisi prius oyer &
Terminer and Gole deliver ^to be^ held at dividing Creek in Somerset County the first tuesday of Aprill
then next to answer unto his Lordship of and Concerning the Robbery afd &c but for want thereof
the Said Richard Driskill is Committed into the Custody of the Sher Somerset County there to Remain &c
the Said sher to witt Joshua Caldwell Gent present here in Court took Charge of ye said Richard Driskill
accordingly &c
                                    Likewise it is Ordered by the Court ^here^ that James Shirley of Somerset County
Gent Give Recognizance in ten pounds Sterling for his appearance before his Lordships Justices of the
next assize nisi prius oyer and terminer and Goal deliver to be held at dividing Creek in Somerset
County the first tuesday of Aprill next to give Evidence on behalfe of his Lordship against a Certain
Richard Driskill of and Concerning a Certain Robbery by him Committed &c

             Whereupon the Said James Shirley present here in Court in his proper person acknowledged
himselfe to Owe and Stand Justly Indebted unto his Said Lordship the Lord Proprietary in the sume
of ten pounds Sterling good and Lawfull money of England of his Goods and Chattells Lands &
tenements to the use of his Said Lordship the Lord Proprietary his heirs and Successors if
it Happen that the afd James Shirley do not make his personall appearance before the
Justices of assize Nisi prius oyer and terminer and Goal delivery to be held at dividing Creek
in Somerset County the first tuesday of Aprill next and do not then and there Give Such
Evidence as he knows against the afd Richard Driskill of and Concerning the Robbery afd &
do not thence depart without Leave of the afd Justices &c

       Thereupon Command was Given to the sher of Somerset County that he should take ye said Anthony
