282 an assault made and him the said John then and there beat wounded and Evilly Entreated so that of his Life it was Greatly dispaired and Other Enormitys to him then and there offered to the Great damage of him the said John and against the peace of the Right honrble the Lord proprietary his good rule & Government &c Test Jno Bennett Robt Jenckins Henry P dom.r Pry On the Backside of the foregoing Bill of Indictment it was thus endorsed viz.t Billa Vera Jno Donelson Foreman Thereupon Command was given to the Sher of Somerset County that he Should take the said James Townsend if &c to answer &c and afterwards in the Same Court Came the said James Townsend in his proper person and being Instantly demanded how he would acquitt himselfe of the trespass and assault aforesaid as by the Indictment afd above upon him Imposed says that of the trespass and assault aforesaid by the Indictment upon him Imposed he is not Guilty thereof and thereof for tryall he putts himselfe upon the Country and Rob.t Jenckins Henry Gent who for his said Lordship in that part prosecutes Followeth and afterwards the afd James Townsend in his Own proper person Relinquisheth his Verification aforesaid by him above pretended and Says that of the trespass and assault aforesaid as by the Indictment afd he is willing Gilty thereof and puts himselfe upon the favour of the Court &c Whereupon all and Singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had It is Considered by the Court here that the aforesaid James Townsend pay unto his Lordship the Lord proprietary for his fine here upon him Imposed by Occasion of the trespass and assault aforesaid whereof in form aforsaid he is Convict one hundred pounds of tobacco and that the said James Townsend be taken to Satisfie his said Lordship of the fine afd the sher of Somerset County (to witt) Joshua Caldwell Gent present here in Court took Charge of the Said James Townsend accordingly &c Patrick Daley appears here in Court according to his Recognizance Entered into before Cap.t John Scott one of his Lordships Justices of the peace for Somerset County for his good behaviour and appearance at this Court and nothing being objected against ^him^ he and his Security were accordingly discharged Ambross Riggin Jun.r appears herein Court according to his Recognizance taken before Mr John Handy One of his Lordships Justices of the peace for Somerset County for his good behaviour and appearance at this Court and for as much as Nothing was Objected against him to Continue him bound therefore he and his Security were accordingly discharged &c Elgate Hitch appears here in Court according according to his Recognizance taken before Mr John Handy one of his Lordships Justices of the peace for Somerset County for his good behaviour and appearance at this Court |
