281 our Lord One Thousand seven hundred and thirty two with force and Armes &c at the County of Somerset aforesaid in and upon a Certain Joseph Houston in the peace of God and the aforesaid Lord Proprietary then and there being an assault did make and him then and there did ^beats wounded & Evilly Entreated so that of his Life it was greatly despaired & other Enormities to him then & there did^ to the Grievous damage of him ye said Joseph and against the peace of ye Right Honrble the Lord Proprietary Robt Jenckins Henry P Dom pry Test Joseph Houston On the back side of the foregoeing bill of Indictm.t it was thus Endorsed viz.t Billa Vera John Donelson Foreman Thereupon Command was given to the sher of Somerset County that he should take ye said Solomon Townsend if &c to answer &c and afterwards here at this Court holden at dividing Creek in Somerset County aforesaid the twentieth day of March Anno Dom One thousand Seven hundred and thirty two before the Justices of the Same Court Judicially Sitting Came the aforesaid Solomon Townsend in his proper person according to a Certain Recognizance by him and his pledges in that part before acknowledged and being Instantly demanded how he would acquitt himselfe of the trespass and assault aforesaid as by the Indictment afd above upon him Imposed says that of the trespass and assault aforesaid above upon him Imposed he is Guilty thereof and puts himselfe upon the favour of the Court whereupon all and Singular the premisses by the Court here being seen heard and fully understood It's Considered by the Court here that the aforesaid Solomon Townsend pay unto his Lordship the Lord Proprietary for his fine hereupon him Imposed by occasion of the trespass and assault aforesaid whereof in form afd he is Convict two hundred pounds of tobacco and that the said Solomon Townsend be taken to Satisfie his said Lordship of the fine afd the Said sher to witt Joshua Caldwell Gent present herein Court took Charge of the said Solomon Townsend accordingly &c Whereupon the said Solomon Townsend appears to his recognizance for the Good behaviour and he and his Security are accordingly discharged thereupon the Said Solomon Townsend is ordered to Give new Recognizance for his good behaviour and appearance at June Court next &c Whereupon the Said Solomon Townsend with John Townsend Junr Late of Somerset County planter his Security both present here in Court in their proper persons did acknowledge themselves to Owe and Stand Justly Indebted unto his Lordship the Right honrble the Lord proprietary his heirs and Successors in the Sum of ten pounds Sterling Each of their goods and Chattells Lands and tenements Seperately to be made and Levied to the use of his said Lordship his heirs and Successors If it happen that the said Solomon Townsend do not make his personall appearance before the Justices of his Said Lordships County Court of Somerset to be held at dividing Creek the third tuesday of June next and do not stand and abide the Judgment ^of the Court^ And do not in the meane time be of the good behaviour towards his said Lordship and all Other the people of this province &c then this recogn to be in form &c otherwise &c
