276 Whereupon the said Theophilus Dennis in his Own proper person appears and there upon the said Theophilus Dennis at the prayer of the aforesaid Lazarus Maddox by his attorney aforesaid is adjudged to give Speciall bail to the action aforesaid Whereupon a Certain Samuel Stevens and Solomon Dennis of Somerset County planters present herein Court in their proper persons undertake for ^the said^ Theophilus Dennis & that in Case the Said Lazarus Maddox that if in Case the said Lazarus Maddox shall recover Judgm.t in the plea aforesaid against the said Theophilus Dennis or that the said Theophilus shall be therein convict that then he the said Theophilus shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset county in satisfaction thereof or that they the said Samuel Stevens and Solomon Dennis will do the same for them &c Thereupon the said Theophilus in his Own proper person comes and defends the force and Injury when &c and says that he Cannot Gainsay the action aforesaid of the aforesaid Lazarus nor but that he did assume upon himselfe in manner and form as the aforesaid Lazarus above against him hath Complained and as to the damage of the Same Lazarus by him by Occasion of the premisses in that part Sustained the Same Theophilus says and confesseth that the aforesaid Lazarus has Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to One Cow of the age aforesaid and tenn bushells of Indian Corn and not more and because the aforesaid ^Lazarus^ deny's not this but the same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid It is Considered that the aforesaid Lazarus Maddox Recover against the aforesaid Theophilus Dennis his damages aforesaid to the aforesaid Cow of the age aforesaid and tenn bushells of Indian Corn by the same Theophilus in form aforesaid Confessed as 239 also Two hundred and thirty Nine pounds of tobacco for his Costs and Charges aforesd to the same Lazarus at his request by the Court here and Consent of the parties aforesaid adjudged and the aforesaid defendant in mercy &c
Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November then next to satisfie John Britt as well of a Certain debt of seven hundred pounds of tobacco which to the Same John Britt by his Lordships County Court of Somerset at dividing Creek Recovered against him as of two hundred and Seventy Seven pounds of tobacco which to the same John Britt the Same Court were adjudged for his damages which he had by Occasion of the detaining of |
