274 Pursuant to an act of assembly ^in this province^ in Such Case made and provided (now in force) and by vertue of the aforesaid warrent was Issued the following attachment against the Goods Chattells rights and Creditts of the aforesaid George Martin in these words viz.t Somerset County ss Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &c To the Sherr of Somerset County Greeting we Command you that you attach any the Goods Chattells Rights or Creditts of George Martin Late of Somerset County Marchant if they Shall be found in your bailywick to the Value of One thousand pounds of tobacco and when you have the Same attached or any part thereof the same in your Custody safe keep so that you have the same before Our Justices of Our County Court of Somerset to be held at Dividing Creek the third tuesday of Novemb.r Next then and there there to be Condemned According to Act of Assembly to and for the Use of a Certain W.m Jones Unless the said George Martin by himselfe or his attorney shall appear and answere unto the said W.m Jones in a plea of threpass upon the Case &c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or Person's in whose hands you make the Same Attachment that he she or they be and appear before our Justices of our County Court to be held as aforesaid to shew Cause if any he she or they have why the Same goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to Act of Assembly in Such Case made and provided if to him ^her or them^ it Shall Seem ^mete^ and how shall shall Execute this writt that you make known unto our said Justices at the Day and place aforesaid and have you then and there this Writt Wittness Robert King Gent Chief Justices of our said Court the Eighteenth Day of August In the Eighteenth Year of our Dominion &c Ann Dom One thousand Seven hundred and thirty two Att which said third tuesday of Novemb.r to witt the twenty first Day of the same Month Ann Domini One thousand Seven hundred and thirty two being the Day of the Returne of the said Writt Cometh the said W.m Jones by his Attorney and the Sheriff of Somerset County to whome the foregoing writt was Directed Likewise Came and made Returne thereof to the Court here Endorsed in these Words following Vizt By Vertue of the Within writt to me Directed to the Justices within Mentioned I Certifie that on the Eighteenth Day of Octob.r 1732 I have attached in the hands of W.m Jones to the Value of Seven hundred pounds of tobacco and I furder Certifie that by John Doe and Richard Roe Lawfull men of my bailywick that I have made known that he be and appear at the Place and time appointed &c Js.o Caldwell Sher Whereupon the aforesaid William Jones by Levin Gale his attorney Comes here into Court and prays that upon Giving Security according to act of assembly in such Case provided that the afd Seven Hundred pounds of tobacco so as afd in his hands attached as ^of^ the rights and Creditts of the afd George Martin may be Condemned to Satisfie the Said Willm Jones of his damages and Costs accrewing upon the attachment afd Whereupon a Certain Francis |
