273 County Court of Somerset to be held at dividing Creek the third tuesday of November then next to answer unto Abraham Smith of a plea of trespass of trespass upon the Case &c and that thereof he should not fail &c Att which said third tuesday of November to witt the SIxteenth day of the same month anno Dom One thousand Seven hundred and thirty One being the day of the return of the same writt Cometh the said Abraham Smith by William Beckingham his attorney and the sher of Somerset County to whom the Same Writt was directed Came and made return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P Josh.a Caldwell sher Whereupon the Said John Bishop being Called appears and thereupon the Said John Bishop at the prayer the prayer of ^the afd^ Abraham Smith by his attorney aforesaid is adjudged to give Speciall bayle to the action aforesaid Thereupon a Certain Edward Rownd of Somerset County Gent present here in Court undertakes for the Same John Bishop that if in Case the said Abraham Smith Shall recover Judgm.t against the said John Bishop in the plea afd or that the Said John Bishop shall be therein Convict that then he the said John Bishop shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said Edward rownd will do the same for him &c Thereupon the said John Bishop by James Shirley his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the Same days is Given to the afd Abraham Smith here also &c Att which said next Court to witt the twenty first day of March anno Dom One thousand Seven hundred and thirty One Came again as well the aforesaid Abraham Smith as the afd John Bishop by their attorneys aforesaid and Thereupon said John Bishop prays further Leave thereof to Imparle here untill Next Court and he hath it and the same day is Given to the afd Abraham Smith here also &c Att which said next Court to witt the ^twentieth day^ of June Ann Dom one thousand Seven hundred and thirty two Came againe as well the aforesd Abraham Smith as the aforesd John Bishop by their Attorneys aforesd and whereupon the Same John Bishop prays further Leave thereof to Imparle here untill Next Court and he hath it and the Same Day is given to the aforesd Abraham Smith here also &c Att Which said Next Co.t to witt the fif^teen Day^ of August Ann Domini One thousand Seven hundred and thirty two Came again as well the aforesd Abraham Smith as the aforesd Jn.o Bishop by their Attorneys aforesd and Whereupon the Same John Bishop Prays further Leave thereof to Imparle here untill Next Court and he hath it and the Same Day is given to the aforesd Abraham Smith here also &c Att Which said Next Court to Witt the twenty first Day of Novemb.r Ann Dom One thousand Seven hundred and thirty two Came againe as well the aforesd Abraham Smith as the aforesd John Bishop by their Attorneys aforesd and the same Abraham Smith then and there his writt aforesaid against the aforesaid John Bishop did not prosecute with Effect but Voluntarily permitted his Suit to be discontinued &c Therefore afterwards to witt the same day by discretion of the Justices here were |
