272 Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the aforesaid William Fasit here also &c Att which said next Court to the Fifteenth day of August Anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid William Fasit as the aforesaid William Whittington by their attorneys aforesaid and whereupon the same William Whittington prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid William Fasit here also &c Att which said next Court to witt the twenty first day of November Anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid William Fasit as the aforesaid William Whittington by their attorneys afd and whereupon the same William Fasit prays that the afd William Whittington to his declaration aforesaid may answer Thereupon the said William Whittington by his said attorney as before defends the force and Injury when &c and says that he Cannot gainsay the action the action the action aforesaid of the aforesaid William Fasit nor can he say but that the same William Whittington assumed upon himselfe in manner and form as the aforesaid William Fasit above against him Complained and as to the damage of the same William Fasit by him by Occasion of the premisses in this part Sustained the Same William Whittington Says and Confesseth that the aforesaid William Fasit has Sustained damages by Occasion of the premisses beyound his Costs and Charges ^by him about his suit^ in that part apposed to three pounds Currant money and not more and because the aforesaid William Fasit denys not this but the ^same^ allegation confesseth to be true prays Judgment and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid William Fasit Recover against the aforesaid William Whittington his damages aforesaid to the aforesaid three pounds Currant money of Maryland by the same William Whittington in form afd Confessed as also Two hundred 292 & Ninty two pounds of tobacco for his Costs and Charges aforesaid to the same William Fasit at his request by the Court here and Consent of the parties afd adjudged and the afd deft in mercy &c Whereupon the aforesaid William Whittington at the prayer of the afd William Fasit by his attorney aforesaid is adjudged to give speciall bail to the action afd thereupon a Certain John Dennis Jun.r present here in Court undertook for the said William Whittington that if in Case the said William Fasit should recover Judgmt in the plea afd against the said William Whittington or that the said William Whittington should be therein Convict that then the said William Whittington shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said John Dennis will do the same for him &c memorand.m this bail peice should have been entered in Novem Court one thousand seven hundred and thirty One but was Omitted and entered here &c
