170   were adjudged ^to^ the Same John Bishop One hundred & Seventy             pounds of tobacco for his Costs and Charges
by him about his defence in that part Sustained according to the form of the Statute in Such Case made and provided &
the afd Abraham Smith in Mercy & the afd Jno have thereof Execution &c

 Somerset County ss  William Wye Jun.r Late of Somerset County Marriner was
attached to answer unto William Horsey of a plea of trespass upon the Case &c
And whereupon the said William Horsey by Francis Allen his attorney Complaines
that whereas the said William Wye the thirteenth day of december anno Dom Seventeen hundred and thirty
One at Somerset County aforesaid within the Jurisdiction of this Court was Indebted unto the said Willm
Horsey in three pounds Seven Shillings Current Money of Maryland and Six hundred
Hundred ^and^ five pounds of tobacco for Sundrys properly Chargable in Account as by
Account hereto Annexed may in Court appear and being so thereof Indebted the said
W.m Wye in Consideration thereof the Day and Year aforesd at the County aforesaid within
Jurisdcon afd upon himselfe Did Assume and to the Said W.m Horsey
then and there did faithfully promise that he the said W.m Wye the aforesaid three
pounds Seven Shillings and Six hundred and five pounds of Tobacco to the said
W.m Horsey when he Should be thereunto Requested he would well and faithfully
pay and Content and Content and altho the said W.m Wye five hundred
pounds of tobacco and One Shilling and three pence percell of the aforesd three
pounds Seven Shillings and Six hundred and five pounds of tobacco to the
Said W.m Horsey he hath Paid and Satisfied Yett as to three pounds five shillings
and Nine pence and one hundred and five pounds of tobacco Residue of the afd
three pounds Seven Shillings and Six hundred and five pounds of tobacco the
said Wm Wye his promise and assumption aforesd in forme aforesd Made Nothing
Regarding but plotting and fraudulently Intending the said W.m Horsey
in that Pte Craftilly and Subtilly to Deceive and Defraud the said three
three pounds Five Shillings and Nine pence and one hundred and five pounds
of tobacco to the said W.m Horsey altho the same to Doe the said W.m Wye by the
said W.m Horsey on the aforesd thirteenth Day of December in the Year aforesd
and often afterwards at Somerset County aforesd within the Jurisidicon aforesd
he was thereunto Requested hath not paid or Contented but the same to him
hitherto to pay or Content hath Refused and Still Doth Refuse and
Deny Whereupon the said W.m Horsey Saith he is worse and hath Damage
to the Value of Eight Pounds Current Money of Maryland aforesd and thereupon
he brings Suit                                                   Pledges Jno Doe R Roe

Thereupon the aforesd W.m Wye by Thomas Bluet his Attorney Comes and Defends
the force and Injury when &c and prays Leave thereof to Imparle here untill
Next ^Court^ and he hath ^it^ and the same day is given to the aforesd William Horsey
here also &c                 Att which said Next Court to witt the twentyeth Day of June
