Our Lord God seventeen hundred and five (to witt) the tenth day of May which was in the year of our Lord God seventeen hundred and thirty One at somerset County aforesaid did draw his Certain note in Writing Called a promisary note with his proper hand subscribed bearing date the same day and Year Last Mentioned and that note unto the same William Fasit then and there did deliver by which same note the same William Whittington did promise to pay unto the same William Fasit or Order the Sum of three pounds currant money of Maryland and by reason thereof as also by Force of the Statute in such Case lately made and provided the same William Whittington became Lyable to pay unto the said William Fasit the aforesaid three pounds Curr money according to the tenor of the note aforesaid and so being Lyable the aforesaid William Fasit ^Whittington^ in consideration thereof afterwards to witt the tenth day of June which was in the Year of Our Lord God seventeen hundred and thirty one aforesaid at Somerset County aforesaid upon himselfe did assume and unto the same William Fasit then & there faithfully did promise to pay unto William Fasit the aforesaid Sum of three pounds Curr money according to the tenour of the note aforesaid Nevertheless the aforesaid William Whittington his promise and assumption aforesaid not regarding but minding and fraudulently Intending the same W.m Fasit in this part craftilly and subtilly to deceive and defraud the aforesaid Sum of three pounds Curr money or any part thereof unto the same William Fasit hath not paid (altho' to do the same by the aforesaid William Fasit afterwards to witt the Eleventh day of June in the Year of Our Lord God One Seventeen hundred and thirty two at the County aforesaid the aforesaid William Whittington was required) but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same William Fasit of Six pounds Like money and thereupon he bringeth Suite &c Pledges &c Jno Doe R Roe And the aforesaid William Whittington by Levin Gale his attorney comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid William Fasit here also &c Att which said next Court to witt the twenty first day of March Anno Dom One thousand seven hundred and thirty One Came againe as well the aforesaid William Fasit as the aforesaid William Whittington by their attorneys aforesaid and whereupon the same William Whittington prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid William Fasit here also &c Att which said next Court to witt the twentieth day of the June month anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid William Fasit as the afd William Whittington by their attorneys afd and whereupon the same William Whittington prays further Leave |
