1732 270 Refused and Still Doth Refuse to the Damage of the same Abraham thirty Pounds Current Money and thereof he bring Suit &c Jno Doe Pledges &c R Roe whereupon the ^afd^ Edward Adams by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prays Leave ^thereof^ to Imparle hereunto untill the next Court and he hat it and the same day is given to the aforesaid Abraham here also &c Att which said next Court to witt the seventeenth day of november ann.o Dom One thousand seven hundred and thirty One came againe as well the aforesaid Abraham Ingram ^as the afd Edward Adwards^ by their attorneys aforesaid and whereupon the said Edward Adams prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Abrah^am^ here also &c Att which said next Court to witt the twenty first day of march Anno Dom One thousand Seven hundred and thirty One Came againe as well the aforesaid Abraham Ingram as the aforesaid Edward Adams by their attorneys aforesaid and whereupon the same Edward prays Further Leave thereof to Imparle here untill next Court and he hath it and the same day is given unto the aforesaid Abraham here also &c Att which said next Court to witt the twentieth day of June Anno Dom One thousand seven hundred and thirty two came againe as well the aforesaid Abraham Ingram as the aforesaid Edward Adams by their attorneys aforesaid and whereupon the same Edward prays further LEave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Edward here also &c Att which said next Court to witt he fifteenth day of August anno Dom One thousand seven hundred and thirty two Came againe as well the aforesaid Abraham Ingram as the aforesaid Edward Adams by their attorneys aforesaid and whereupon the same Abraham prays that the afd Edward to his declaration aforesaid may answer and the same attorney of the Same Edward says that he is not Informed by the same Edward his Clyant of any answer for the same Edward to the aforesaid Abraham in the plea aforesaid to be given and nothing Els thereof says by which the Same Abraham remaineth against the aforesaid Edward thereof undefended wherefore the same Abraham his damages by Occasion of the nonperformance of the promise and assumption afd against the aforesaid Edward Ought to recover but because it is not known what damages the aforesaid Abraham has sustained by Occasion of the nonperformance of the promise and assumption aforesaid Therefore it is Commanded the sher of Somerset County that by the Oath of honest and Lawfull men of his bailywick or County he diligently Inquire what damages the aforesaid Abraham has sustained as well by Occasion of the nonperformance of the promise and assumption afd as for his costs and Charges by him about his suit in this part apposed and the Inquisition which thereupon he takes he make appear to his Lordships Justices of the Coty Court of Somerset to be held at dividing Creeks the third tuesday of November then next under his seal and the seals of those by whose Oath he takes the same Inquisition he send together with his Said Lordships to him thereof directed and the same day is given to the aforesaid Abraham here also &c Att Which said |
