270 Somerset County to whom the foregeoing writt was directed Likewise Cometh and maketh return thereof to the Court here endorsed in these words following viz.t Non est Inventus short note Left in Josa Caldwell sher whereupon the said Richard Waters by Thomas Bluet his attorney aforesaid prays that for as much as he has Complyed with the Law in Order for an attachment he may have Judgm.t against the said John Shapleigh for his damages afd by way of attachement according to act of assembly &c and Where as it seemeth to the Court here that the aforesaid Richard Waters has complyed with the Law as alledged Therefore it is Considered by the Court here that Richard Waters Recover against the aforesaid John Shapleigh as well the sum of thirty pounds Sterling his damages aforesaid by Occasion of the premises as also all Costs and Charges by the said plft Laid out and expended about his suit by way of attachment against the goods Chattells rights or Creditts of the said John Shapleigh according to act of assembly in such Case made and provided &c
whereas the afd Edward in consideration that the afd Abraham would hire unto the afd Edward a certain Cost and two horses to transport sundry goods from Sussex County upon delaware to Somerset County aforesd the tenth Day of August Ann Domini Seventeen hundred and Twenty Nine at Somerset County upon himselfe assumed and to the same Abraham then and there faithfully did promise that he the same Edward not only so much Money as he the said Abraham should Reasonably Deserve for the Use of the said Cart and horses would well and truly Content and pay but also would well and truly returne unto the same Abraham the Cart and horses aforesd when thereunto Required And the aforesd Abraham in fact Saith that he the said Abraham afterward to witt the Day and Year aforesd at Somerset County aforesd did hire and Deliver unto the aforesd Edward the Cart Cart and horses aforesd for the Use aforesd Nevertheless the aforesd Edward his promise and assumption aforesd Nothing regarding but and fraudulently Intending the same Abraham in that part Craftilly and Subtilly to Deceive and Defraud the Cart and horses aforesd Altho' often thereunto particularly on the tenth Day of Decemb.r in the Year aforesd at the County aforesd by the same Abraham Required hath not Returned or Delivered but the Same to him to Returne or deliver hitherto altogether hath Refused |
