269 Therefore it is Considered by the Court here that the aforesaid ten shillings Currant Money so as aforesaid attached and Confessed be Condemned in the hands of the said George Howard as of the rights and Creditts of ye aforesaid Richard Poltney towards satisfying unto the said John Collings his damages and Costs aforesaid and all Costs accrewing upon this writt of attachment and that the said John Collings have thereof his Execution &c
court of Somerset ^to be held at dividing Creek^ the third tuesday of November then next to answer unto Richard Waters of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Richard Waters by Thomas Bluett his attorney Complaines against the said John shapleigh in the plea afd as followeth &c Somerset County ss John Shapleigh Late of Somerset County Gentleman was attached to answer unto Richard Waters of a plea of trespass upon the Case &c And whereupon the Said Richard by Thomas Bluett his attorney Complaines that when the said John the Ninteenth day of July in the Year of Our Lord One thousand seven hundred and twenty Eight at at Somerset County aforesaid within the Jurisdiction of this Court was Indebted to the said Richard in the Sum of thirty pounds Sterling as p a Certain ^note^ by the said John signed may appear and being so therefore Indebted the said John in Consideration thereof afterwards (to witt) the Day and Year aforesd at Somerset County aforesd and Within the Jurisdiction of this Court upon himself Did assume and to the said Richard then and there faithfully promised that he the said John the said thirty pounds Sterling to the said Richard when he should be thereto Required well and faithfully would pay and Content Nevertheless the said John the said John his promise and assumption afd in forme afd made Noe ways Regarding but Designing and fraudulently Intending the said Richard in that part to Deceive and Defraud the said thirty pounds Sterling or any part thereof to the said Richard hath not paid or any ways satisfied altho this to Doe the said John afterwards to witt the same Day and the Year aforesd at Somerset County aforesd by the said Richard was Required but the Same to him to pay or Satisfie hath hitherto altogether Refused and Still Doth Refuse to the Damage of him the said Richard of sixty pounds Like Money and thence he brings Suit &c Jno Doe T Bluet P Qur Pledges &c R Roe Att which said third tuesday of November to witt the twenty first day of the Same month anno Dom One thousand Seven hundred and thirty two Came ag the said Richard Waters by his attorney aforesaid and the sher of Somerset |
