269 appears in his proper person and says that he Cannot Gainsay but that he has of the rights and Creditts of the said Richard Poltney, One Stear of two Years and halfe old (which is valued by the Court to twenty shillings Curr money) three Gallons of Molassos (of the value of five shillings Currant Money) one fish gigg and Butter pottt of the Value of two shillings Currant Money) which said stear three Gallons of Mollassos, Fish gigg and Butter pott according to the Valuation aforesaid amounts to twenty Seven Shillings Cur money Likewise the said George Howard Garnishe of the aforesaid Richard Poltney appears in his proper person and says that he Cannot Gainsay but that he has of the Rights and Creditts of the afd Richard Poltney to ten shillings Currant money nor Can they say but that the Same Ought to be condemned in their hands for the use of the Said John Collings as of the rights and Creditts of the said richard Poltney which ye Said Plft doth not Gainsay &c Whereupon the afd John Collings by his attorney afd prays that upon Giveing Security according to act of assembly the afd thirty one bushells and three pecks of Indian Corn of the value of forty two shillings and four pence Currant mony so as afd Confessed by the aforesaid Thomas Bowden, One Stear, three Gallons of Mollassos, Fish Gigg and Butter pott all of the value of twenty Seven shillings Currant mony ^so as aforesaid Confessed by the afd Will.m West^ and ten shillings Currant money so as afd Confessed by the afd George Howard as of the rights and Creditts of the afd Richard Poltney may be Condemned in the hands of the afd Thomas Bowden, William West and George Howard towards satisfying unto the said John Collings his damages and Costs accrewed &c Thereupon a Certain John Smith of Somerset County Gent present here in Court under takes for the Said John Collings according to act of assembly that in Case the said Richard Poltney do at any time within a year and a day appear and make all or any part of the said John Collings Claim against him appear to be satisfied or otherwise to have been undue before the Laying of this attachment that then the said John Collings shall make restitution unto the said Richard Poltney of all or such part thereof as shall be made appear to be undue &c or that he ye said John Smith will do it for him &c Therefore it is Considered by the Court here that the afd Sum of thirty one and bushells and three pecks of Indian Corn of the Value of Forty two shillings and four pence Currant Money of Maryland so as afd Confessed be Condemned in the hands of the said Thomas Bowden as of the rights and Creditts of the afd Richard Poltney towards Satisfying unto the Said John Collings his damages and Costs afd and al Costs accrewing upon this Writt of attachment and that the Said John Collings have thereof Execution &c Therefore it is Considered by the Court here that the afd Stear of two years and halfe old three Gallons of Mollassos, One Fish Gigg, and Butter pott all of the value of twenty Seven shillings Currant Money of Maryland so as afd Confessed be Condemned in the Hands of ^the said^ Wm West as of the rights and Creditts of ye afd Richard Poltney towards satisfying unto the said John Collings his damages and Costs afd and ^all^ Costs accrewing upon this Writt of attachment and that the said John Collings have thereof his Execution &c Therefore |
