269 Richard Poultney Late of Somerset County Planter if they Shall be found in Your bailywick to the Value of Eleven pounds ten Shillings in Silver or Gold and Six hundred pounds of Tobacco and when you have the Same attacheed or any part thereof the Same in Your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset to be held at Dividing Creek the third tuesday of Novemb.r Next then and there to be Condemned according to act of assembly to and for the use of a Certain John Collins Unless the Said Richard Poltney by himselfe or his attorney Shall appear and answere unto the Said John Collins of a plea of trespass upon the Case &c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they ^be^ and appear before our Justices of our County Court to be held of Dividing aforesaid to Shew Cause if any he she or they have why the Same goods Chattells Rights or Creditts so attached in her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in Such Case made and Provided if to him her or them it Shall Seem meet and how you Execute this writt that you make known unto our said Justices at the Day and place afd and have you then and there this Writt Wittness Robert King Gent Chief Justices of our said Court the Ninteeen Day of August In the Eighteenth Year of our Dominion &c Ann Dom one thousand Seven hundred and thirty two Att which said third tuesday of Novemb.r to witt the twenty first Day of the Same month Ann Dom one thousand Seven hundred and thirty two being the Day of the Returne of the Said Writt Came the Said John Collins by Robert Jenkins Henry his Attorney and the Sherife of Somerset County to whome the foregoing writt was Directed Likewise Came and made returne thereof to the Court here Endorsed in the Words following Vizt By Vertue of the within writt to me Directed to the Justices within Mentioned I Certife that on the ^Ninth^ Day of Octob.r one thousand Seven hundred and thirty two I attached in ^ye^ hands of Thomas Bowden fifty shillings Current Money in the hands of W.m West thirty Shillings Current Money In the hands of George Howard ten Shillings Like money and I further Certifie that by Littleton Towensand and Richard Row Good and Lawfull men of my bailywick I have made known unto the Said Thomas Bowden, W.m West and George Howard that they be and appear att the time and place within Contained as by the within Preceipt I am Comanded so answere Joshua Caldwell sher And whereupon the aforesaid Thomas Bowden Garnishe of the aforesaid Richard Poltney appears in his proper person and Says that he Cannot Gainsay but that he has of the Rights and Creditts of the Said Rich.d Poltney in his hands thirty One bushells and three pecks of Indian Corn which is valued by the Court to Forty two shillings and four pence Currant Money Likewise the afd William West Garnishe of the afd Richd Poltney appears |
