268 Tobacco and When you have the Same attached or any part thereof the Same in Your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset to be held at Dividing ^Creek^ the third tuesday of Novemb.r Next then and to be Condemned According to Act of Assembly to and for the Use of a Certain Samuel Long Executors of the Last Will and testament of Jeffery Long Dec.d Unless the Said Nathaniel Foche, James Peirce, John Wood Adm.rs of the Said Hugh Arbuthnot Dec.d by themselves or their attorneys Shall appear and answere unto ^the said^ Sam.l Long in a plea of Trespass upon the Case According to Law and that ^by^ good ^and^ Lawfull men of Your bailywick you make known unto the Person or persons in whose hands you make the Same Attachment and that he She or they be and appear before our Justices of our County Court to be held as aforesd to Shew Cause if any he She or they have Why the Same goods Chattells Rights or Creditts so Attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to Act of Assembly in Such Case made and provided if to him her or them it Shall seem meet and how you Shall Execute this writt that You make unto our said Justices at the Day and place aforesd and have you then and there this Writt Wittness Robert King Gent Chief Justices of our said Court the Nineteenth Day of August In the Eighteenth Year of our Dominion &c Ann Dom one thousand Seven hundred and thirty two Att which said third tuesday of November to witt the twenty first day of the Same month anno Dom one thousand Seven hundred and thirty two being the day of the return of the Said Writt Cometh the Said Samuel Long by his attorney aforesaid and the sher of Somerset County to whom the foregoeing writt was directed Likewise Came and made return thereof to the Court here Endorsed in those words following viz.t By Vertue of the within writt to me directed to the Justices within Mentioned I Certifie that I have attached in the hands of William Thompson to the Value of Six pounds Three shillings Sterling and Six hundred pounds of tobacco and I further Certifie that by John Doe & richard roe honest and Lawfull men of my bailywick I have made known unto the said William Thompson that he be and appear at the time and place within Contained to shew &c as by the within writt I am Commanded Joshua Caldwell sher Whereup^on^ the Said W.m Thompson (Attorney in Fact of Andrew Thompson) Garnishe of the aforesd Nathaniel Foche, James Peirce, and John Wood Adm.rs of the aforesaid Hugh Arbuthnot Dec.d by Levin Gale his Attorney Comes and Says that he Cannot Gainsay but that the Said W.m Thompson (as Attorney in fact of the aforesd Andrew Thompson) has of the Rights and Creditts of the said Nathaniel Foche James Peirce and John Wood Adm.rs ^as^ afd to the Value of Six pounds three Shillings Ster and Six hundred pounds of Tobacco so as aforesd ^attached^ nor but the Same Ought to be Condemned in the hands of the Same W.m Thompson (as Attorney in |
