268 Shillings ^and five pence Ster^ and Eight hundred pounds of Tobacco so as aforesd Attached nor but the Same ought to be Condemned in the hands of the Same W.m Thompson (as attorney in fact of the Said Andrew Thompson) for the Use of the Said Ephraim Willson as of the Rights and Creditts of the Said Nathaniel Foche James Peirce and John Wood Adm.rs as aforesd which the Said Pleft Doth not Gainsay Whereupon the said Ephraim Willson by his attorney aforesd prays that upon giving Security According to act of assembly the aforesd twelve pounds three Shillings and five pence Ster and Eight hundred pounds of Tobacco so as aforesd attached and Confessed as of the rights and Creditts of the aforesaid Nathaniel Foche, James Peirce and John Wood administrators as afd may be condemned in the hands of the said William Thompson (as attorney in fact of the aforesaid And.w Thompson) towards Satisfying the said Ephraim Wilson his damages afd and Costs accrewing &c Therefore it is Considered by the Court here that the said sum of twelve pounds three shillings and five pence Sterling and Eight hundred pounds of tobacco so as aforesaid attached and Confessed be Condemned in the hands of the said William Thompson (as attorney in fact of the said And.w Thompson) as of the rights and Creditts of the said Nathaniel Foche, James Peirce and John Wood (administrator of the afd Hugh Arbuthnot decd) towards Satisfying unto the said Ephraim Wilson his damages and Costs aforesaid and al Costs accrewing upon this writ of attachment and that the said Ephraim Wilson have thereof his Execution according to act of assembly &c Thereupon a Certain Robert King of Somerset County Gent present here in Court in his proper person undertakes for the said Ep^h^raim Wilson according to act of assembly that in Case the said Nath.l Foche, James Peirce and John Wood or either of them do at any time within a year and a day ^appear^ and make all or any part of the said Ephraim Wilsons Claim against them appear to be satisfied or Otherwise to have been undue before the Laying of this attachment that then the said Ephraim Wilson shall make Restitution unto them the said Nat Foche, James Peirce and John Wood or to Either of them of all or Such part thereof as shall be made appear to be undue &c or that he said Robert King will do it for him
