268 five pence Sterling and Eight hundred pounds of Tobacco and when You have the Same Attachment or any part thereof the Same in your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset to be held at Dividing Creek the third tuesday of Novemb.r Next than and there to be Condemned According to act of assembly to and for the Use of a Certain Ephraim Willson Unless ^the said^ Nathaniel Foche, James Peirce and Wood Adm.rs of Hugh Arbuthont Dec.d by themselves or their attorney Attorney Shall appear and answere unto the Said Ephraim Wilson in a plea of Trespass upon the Case &c according to Law and that by good and Lawfull men of Your bailywick you make known unto ^the^ Person or person's in whose hands you make the Same attachment that he she or they be and appear before our Justices of our County to be held as afd to Shew Cause if any he she or they have why the same goods Chattels Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in Such Case made and provided if to him her or them it Shall Seem meet and how you shall Execute this Writt that you make known unto our said Justices at the Day and place aforesd and have you then and there this Writt Wittness Robert King Gent Chief Justices of our saiod Court the Nineteenth Day of Aug.t In the Eighteenth Year of our Dominion &c Ann Dom One thousand seven hundred and thirty two Att which said third tuesday of November to witt the twenty first day of the same month Anno Dom One thousand seven hundred and thirty two being the day of the return of the said Wrtt Came the said Ephraim Wilson by Levin Gale his attorney and the she of Somerset County to whom the foregoing writt was directed Likewise Came and made Return thereof to the Court here endorsed in these words following vizt By vertue of the within Writt to me directed to the Justices within Mentioned I Certifie that on the ninth day of Novmeber One thousand seven hundred and thirty two I have attached in the Hands of William Thompson to the Value of twelve pounds three shillings and ^five^ pence sterling and Eighteen Hundred pounds of tobacco as of the rights and Creditts of ye said defts and further I Certifie that by John Thompson that he be and appear at the place and time within Contained to shew &c as by the within Writt I am Commanded Joshua Caldwell she Whereupon the Said W.m Thompson (attorney in fact of Andrew Thompson) Garnishe of the aforesd Nathaniel Foche, James Peirce and John Wood Adm.rs of the aforesd Hugh Arbuthnot Dec.d by Thomas Bluett his Attorney Comes and Says that he Cannot Gainsay but that (the said W.m Thompson (as attorney in fact of the aforesd Andrwe Thompson) has of the Rights and Creditts of the Said Nathaniel Foche, James Peirce and John Wood Adm.rs as aforesd to the Value of twelve pounds three Shillings |
