       November Court   1732                    268

dividing Creek in the same County the twenty first day of November anno Dom One thousand seven hundred &
thirty two before his said Lordships Justices Cometh the afd Tucker Loyd Late of Somerset County according
to a Certain Recognizance by him and his pledges in that part before acknowledged in his proper person
and had a hearing of the Indictment aforesaid and Says that he is not guilty thereof and of this he
putts himselfe upon the Country and Thomas Bluett who for his said Lordship in that part followeth likewise

          Thereupon Command was given to the sher of Somerset County that Immediately he Should Cause to Come
before his said Lordships Justices here twelve &c by whom &c  and who neither &c to Recognize &c because
as well &c and whereupon the Jurors of that Same Jury by Joshua Caldwell Gent sher of the said
County to this Impannelled who being Called Came to witt William Handy, Thomas Humphrys, Edward
Rownd, William White, John Scarbrough, Henry Schofeild, John Webb, Robert Mitchell, John Smith
John Givans, Bruffe Broughton, and Hutton Hill who to say the truth of the premisses being duely Elected
tryed and Sworn upon their Oath did say that the aforesaid Tucker Loyd is Guilty of the Felony afd in
the Indictment afd Specified in manner and form as by the Indictment afd above against him Supposed

    Whereupon the same defendant prays that noe Judgment may be given against him on the afd verdict rendered
against ^him^ on part of his Lordship for that atales decircumstantibus was awarded and returned before
the pannell of the Jurors was gone thro' therefore Judgment ^is^ rendered that the verdict aforesaid given
be held for nothing and that the aforesaid Tucker Loyde of that Same verdict Goe thereof without
day &c whereupon the said Thomas Bluett who for his said Lordship in that part followes &c ^prays^ a new
Tryall in the premises afd and to him it is Granted               Whereupon Came into Court Levin Gale Esq.r
Clerk of the Indictments for Somerset County and saith that he will no further prosecute against the
afd Tucker Loyd of the felony afd &c   Therefore the afd Tucker Loyd as to the felony ^afd^ be quiet and go thereof
without day &c


Lazarus Maddox appears according to his recognizance Entered into to give Evidence against Tucker Loyd
and is discharged

Nicholas Fountain, William Turpin, Joshua Tull and William Wharton appears according to their
Recognizance Entered into to give Evidence against Tucker Loyd and is discharged &c

Memorand.m the plft by Levin Gale his attorney sued out his Lordships

writt of attachment against the deft the tenor whereof followeth in these
words viz.t Somerset ss  Charles absolute Lord and proprietarie of
the provinces of Maryland and avalon Lord Baron of Baltemore &c To the
       Sher of Somerset County Greeting we Comand you that You Attach any the goods
       Chattells Rights or Creditts of ^Nathaniel Foche, James Peirce and John Wood administrators of^ Hugh Arbuthnott Late of London Merchant ^dec.d^  if they
       Shal be found in your bailywick to the Value of twelve pounds three Shillings and
