1732 267 of the Laws of England to the Evil Example of others in such Cases offending against the peace of the Right Honrble the Lord proprietary and against the Act of Assembly in that Case made and provided &c Thereupon Comand was given to the Sher of Somerset County that he Should take the Said Thomas Holbrook if &c to answere &c and afterwards hereat this Court held at Dividing Creek in Somerset County the twenty first day of Novemb.r one thousand Seven hundred and thirty two before the Justices of the Same Court Judicially Setting Came the aforesd Thomas Holbrook in his proper person according to a Certain Recognizance by him and his Pledges in that part before acknowledged and hath a hearing of the Information aforesaid and says that he is not Gilty thereof and of this he puts himselfe upon the Country and Thomas Bluett Gent who for his said Lordship in that part followeth Likewise &c Thereupon Command is given to the sher of Somerset County that Immediately he should Cause to Come before his said Lordships Justices here twelve &c by whom &c and who neither &c to recognize &c because as well &c and whereupon the Jurors of that same Jury by Joshua Caldwell Gent sher of the County aforesaid to this Impannelled who being Called Came (to witt) W.m Handy, Thomas Humphris, Edward Rownd, W.m White, John Sarbrough Henry Scholdfield, John Webb, Robert Mitchell, John Smith, John Givans Bruff Broughton ^and^ Hutton Hill who to say the truth of the premises being Elected tryed and Sworn upon their oath did say that the afd Thomas Holdbrook is not Gilty of the premises afd in the Information Specified in Manner and forme as by the Information afd above against him Suposed Whereupon all and Singular the premises by the Court here Sean ^heard^ and fully understood It is Considered by the Court here that the afd Thomas Holdbrook be quiet &c and goe thereof without Day &c
hundred and Thirty two with force and arms within the County of Somerset aforesaid One Stock Lock of the Value of Eight Shillings Currant money of Maryland of the Goods and Chattells of a Certain Nicholas Fountain then and there found then and there Felonious stole took and Carried away against the peace of the Right honourable the Lord proprietary &c and also against the peace and against the form of the act of assembly in that Case made and provided Bluett P Dom propry Test Joshua Tull, Nicholas Fountain, Wm Turpin & Wm Wharton On the back side of the foregoing bill of Indictment it was thus Endorsed viz.t Billa Vera David Polk Foreman Thereupon Command was Given to the sher of Somerset County that he should take the said Tucker Loyd if &c to answer &c and in manner here to witt at this same term held for Somerset County at dividing |
