November Court
1732 266 Justices of his ^Lordships^ County Court of Somerset to be held at Dividing Creek the third tuesday of August Next to answere unto his Lordships of and Concerning the premises afd and that thereof he Should not fail &c Att which said third tuesday of August to witt the fifteenth Day of the Same Month ann Dom one thousand Seven hundred and thirty two Came as well the afd Thomas Bluett who as well &c as the aforesd Henry Miles by Francis Allen his Attorney and Whereupon by the favour of the Court Specially Admitted the said Henry Defended the force and Injury when &c and prays hearing of the Information aforesd and to him it is Read &c which being Read and heard the Same Henry Prays Leave thereof to Imparle here untill next Court and he hath it and the Same Day is given to the aforesd Thom.s Bluet who &c here also &c Att which said Next Court to witt the twenty first Day of November Ann Dom one thousand Seven hundred and thirty two Came againe as well the aforesaid Thomas Bluett who &c as the aforesaid Henry Miles by his attorney aforesaid and upon this the said Thomas Bluett who &c prays that the said Henry Miles to the premisses in the Information aforesaid Contained may answer &c whereupon the same Henry as before defends the force and Injury and says that of the premisses in the Information aforesaid specified he is noe ways Guilty thereof and of this he putts himselfe upon the Country and Thomas Bluett who for his said Lordship in this behalfe prosecutes Likewise &c And fur^ther^ the said Henry by his said attorney prays the Court that for as much as the Information afd doth not Conclud against the ^form of^ act of assembly it may be quashed &c Whereupon all and Singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had wherefore it seemeth to the Court here that the Information ^afd^ is Insufficient in Law &c Therefore it is Considered by the Court here that the Information aforesaid be Quashed and that the said Henry Miles go thereof without day &c
for the Lord proprietary and gives this Court to Understand and Informed that Furnis Odear Late of the Said County Planter the first Day of Aprill in the Year of our Lord one thousand Seven hundred and thirty one in the County aforesd and within the Jur of this Court did Committ fornication with a Certain Bridgett Phillips of the County aforesd Spinster and on the body of the Said Brigett Philips then and there did begett a bastard Child to the high Displeasure of Almighty God and to the Evil Example of all others in Such Case offending and against the forme of the Act of Assembly in such Case made and provided and Wherefore the Said Thomas Bluet prays the Advice of the Court in the premises and Due process of Law thereon against the Said Furnis to Issue Thereupon Command was given the Sher of Somerset |
