266 Somerset to be held at dividing Creek the third tuesday of August Next to answer unto his Lordship of and Concerning the premises afd and that thereof he should not fail &c Att which said third tuesday of August to witt the Fifteenth day of the Same month Anno Dom One thousand Seven hundred and thirty two Came as well the afd Thomas Bluett who as well &c as the afd Henry Miles by Francis Allen his attorney and whereupon by ^the^ favour of the Court Specially admitted the said Henry defended the force and Injury when &c and prays hearing of the Information aforesaid and to him it is Read &c which being Read and heard the same Henry prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Thomas Bluett who &c here also &c Att which said next Court to witt the twenty first day of November Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd Thomas Bluett who &c as the afd Henry Miles by his attorney aforesaid and upon this the aforesaid Thomas Bluett who &c prays that the aforesaid Henry Miles to the premisses in the Information aforesaid contained may answer &c whereupon the same Henry Miles as before defends the force and Injury when &c and prays the Court that for as much as the Information afd doth not Conclude against the form of the act of assembly it may be quashed &c Whereupon all and Singular the premises by the Court here being seen heard and fully understood and mature deliberation thereupon had wherefore it seemeth to the Court here that the Information afd is Insufficient in Law &c Therefore it is Considered that the aforesaid Henry Miles be quiet &c and go thereof without day
may in the Year of our Lord One thousand seven hundred and thirty two at Somerset County afd did Import into this province to witt into the County of Somerset aforesaid One Negro Slave and did not pay unto the Navell Officer of the County aforesaid the sum of twenty shillings Currant money to be applied for the advancement of Learning to be applied toward the encouragement of one publick School in every County within the province whereby the Said Henry hath Forfeited to the Right Honrble the Lord proprietary the Sum of Five pounds Currant Money to be recovered in any Court of Record in this province by Action of debt plaint or Information wherefore the said Thomas Bluett prays the advice of the Court Concerning the premisses and that due process may Issue &c Thereupon Command was Given to the sher of Somerset County that he should take the said Henry Miles if he should be found in his bailywick and him Should safe Keep so that he might have his body before the Justices |
