November Court
1730 26 both real and personall and Likewise it is further Ordered by the Court that a Certain Peter Collier of Somerset County deliver up unto the aforesaid Robert Nearn all the Estate that he hath in his hands both Real and personall that of Right doth belong unto the afd Francis Thorowgood Drummond &c Whereupon it is ordered by the Court that the aforesaid Robert Nearn Give Recognizance in the Sum of forty pounds Currant mony with two Securitys to the use of the aforesaid Francis Thorowgood Drummond to be Levied &c Thereupon the aforesaid Robert Nearn together with John Dennis Jun.r and Thomas Billing his Securitys all present herein Court in their proper persons and acknowledged themselves to be Indebted unto the aforesaid Francis Thorowgood Drummond in the Sum of Forty pounds Currant mony of Maryland to be Levied of their bodys goods or Chattells Lands or tenements Joyntly and Severally to the use of the said Francis Thorowgood Drummond his heirs or assigns if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden Robert Nearn do and Shall well and truely in every Respect Comply with the Law in Relation to Gardians and Likewise deliver up peaceably and quietly unto the aforesaid Francis Thorowgood Drummond all his Estate that he Shall ^be^ possest with ^that of Rights doth belong to the said francis Thorowgood Drummond^ both reall and personall when he Shall arrive at full age to the same &.c^ then the above recognizance to be void otherwise &c
Whereupon the Said William Burton together with the John Parker and John Mercy his Securitys all present herein Court in their proper persons acknowledged themselves to Owe and ^stand^ Justly Indebted unto the said William Pepper in the Sum of fifty pounds Sterling Joyntly and Seperately of their goods and Chattells Lands or tenements to the use of the said Wm Pepper his heirs or assignes ^to be Levied^ if default be made in the Condition hereunder Written The Condition of the above Recognizance is Such that if the bove bounden William Burton do and shall well & truely in every respect Comply with the Law in relation to Guardians and Likewise deliver up peaceably and quietly unto the aforesaid William Pepper all his estate that he Shall be possest with and which of right doth belong to the said William Pepper both reall and personall when he shall arrive at full age to Receive the same &.c then the above Recognizance to be void and of none Effect Otherwise to remain in full force & vertue &.c
petitioner as in duty bound Shall pray Michael Holland Junr The petition aforesaid being Read and heard and mature deliberation thereupon had Wherefore it is Considered by the Court that the aforesaid Michael Holland have Liberty of turning ye road as by ye petition aforesaid is praid & y.t the new road be made passable & good according to ye direction of Thos Williams & Thos Dixon & they to make their report to Next Court &c |
