255 and have damage to the Value of tenn pounds Currant money and thereof he brings this Suite L Gale P Quer pledges &c Jno Do R Roe And the aforesaid William Wye in his proper person Cometh and defendeth the force and Injury when &c and Saith that he Cannot Gainsay the action aforesaid of the aforesaid William Kitchen and Thomas Gray nor but that he did assume upon himselfe in manner and form as the aforesaid William Kitchen and Thomas Gray above against him have Complained and as to the damage of the Same William Kitchen and Thomas Gray by them by Occasion of the premisses in that part Sustained the same William Wye saith and Confesseth that the aforesaid William Kitchen and Thomas Gray sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to five pounds Currant money of Maryland and noe more and because the aforesaid William Kitchen and Thomas Gray denyes not this but the Same allegation Confesseth to be true pray Judgmt and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &c There^fore^ by Consent of the parties aforesaid it is Considered that the aforesaid William Kitchen & Thomas Gray Recover against ^the afd^ William Wye the damages aforesaid to the aforesaid five pound Currant money of Maryland (243) by the same William Wye in form aforesaid Confessed as also Two hundred & forty three pounds of tobacco for their Costs and Charges afd to the same William Kitchen and Thomas Gray at their request by the Court here and Consent of the parties aforesaid adjudged and the aforesaid deft in mercy &c The Court adjourns untill the third tuesday of November Anno Dom 1732 |
