Dom One thousand seven hundred and thirty One at Somerset County within the Jurisdiction of this Court was indebted to the same William Kitchen and Thomas Gray in the sum of five pounds Currant money of Maryland and so thereof being Indebted the said William Wye in consideration thereof afterwards to witt the same day & Year aforesaid at the County aforesaid and within the aforesaid Jurisdiction upon himselfe assumed and to the same William Kitchen and Thomas Gray then and there faithfully promised that he when afterwards he should be thereunto requested he the aforesaid sum of five pounds Currant money to the Same William Kitchen and Thomas Gray would well and faithfully Content and pay nevertheless the Said William Wye his promise and assumption aforesaid in form aforesaid made not regarding but plotting and fraudulently Intending them the said William Kitchen and Thomas Gray in that part Craftilly and Subtilly to defraud and deceive the aforesaid five pounds Currant money or any part thereof to the Same William Kitchen & Thomas Gray he hath not paid or them for it in any wise Contented altho' the Same to do the aforesaid Will.m Wye afterwards viz.t the same day and year aforesaid at the County aforesaid and within the afd Jurisdiction by the same William Kitchen and Thomas Gray was requested but the same hitherto to do hath altogether refused and still doth Refuse whereby the same William Kitchen and Thomas Gray say they are the worse and |
