253 Injury when &c and says that ^he^ Cannot Gainsay the action aforesaid John Tunstall nor can he say but that the said John Hunt in his Life time did assume upon himselfe in manner and form as the aforesaid John Tunstall above against him hath Complained and as to the damage of the Same John Tunstall by him by Occasion of the premisses in that part Sustained the Same William says and Confesseth that the aforesaid John Tunstall his ^sustained^ damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to three pounds sixteen shillings and three pence Currant money of Maryland not more ^to be Levied^ of the Goods and Chattells ^which were^ of the afd John Hunt at the time of his death ^and^ when to the hands of the afd W.m it shall happen to come to be administred together with his Costs and Charges aforesaid to him adjudged &c Therefore it is Considered by Consent of the parties afd that the afd John Tunstall Recover against the afd WIlliam Jones administrator of the aforesaid John Hunt his damages aforesaid to the aforesaid three pounds Sixteen shillings and three pence Curr money of Maryland by the Same William in form afd Confessed as also Two hundred & five 205 pounds of tobacco for his Costs and Charges by him about his Suit in that part apposed to be Levied of the Goods and Chattells which were of the afd John Hunt at the time of his death and which to the hands of the afd William hereafter shall happen to Come to be administred and ye afd deft in mercy &c
the tenth day of August ann Dom Seventeen hundred and thirty one at Somerset County aforesd within the Jur of this Court was Indebted unto the Said Charles in Six hundred and fifty pounds of tobacco as by a Certain Note may appear and being so thereof Indebted the Said Edward in Consideration thereof the day and Year afd at Somerset County afd within the Jur afd upon himself did assume and to the Said Charles then and there did faithfully promise that he the Said Edward the Said Six hundred and fifty pounds of tobacco to the Said Charles when he Should be thereunto Requested he would well and faithfully pay and Content Nevertheless the Said Edw.d his promise and assumption afd |
