253 afd in forme afd made Nothing regarding but plotting and fraudulently Intending the Said Edw.d in that part Craftilly and Subtilly to Deceive and Defraud the afd Six hundred and fifty pounds of tobacco to the Said Charles altho the Same to do the Said Edw.d by the afd Charles on the Day and year afd and often afterwards at Somerset County afd within the Jur afd he was thereunto Requested hath not paid or to him for the Same in any Sort Contented but the Same to him hitherto to pay or in any Sort to Content hath Refused and Still doth refuse and Deny whereupon he Saith he is worse and hath Damage to the Value of thirteen hundred pounds of Tobacco and thereupon he brings Suit &c pledges &c Jn Doe R Roe And whereupon the said Edward Price in his Own proper person appears and thereupon the said Edward Price at the prayer of the aforesaid Charles Burges by his attorney aforesaid is adjudged to Give speciall bail to the action aforesaid thereupon a Certain John Kellum late of Somerset County wheelwright in his proper person present here in court undertakes for the said Edward Price that if in Case the said Charles Burges shall recover Judgm.t in the plea aforesaid against the aforesaid Edward Price or that the said Edward Price shall be therein Convict that then he the Said Edward Price shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said John Kellum will do the Same for him Whereupon the aforesaid Edward Price in his Own proper person Cometh and defendeth ^the^ force and Injury when &c and saith that he cannot gainsay the action aforesaid of the aforesaid Charles Burges nor Can he say but that he did assume upon himselfe in manner and form as the aforesaid Charles above against him hath Complained and as to the damage of the Same Charles the Same Edward saith and Confesseth that the afd Charles has Sustained damage by Occasion of the premises beyound his Costs and Charges by him about his Suit in that part apposed to Six hundred and fifty pounds of tobacco and no More and because the aforesd Charles Deny's not this but the Same Allegation Confesseth to be true prays Judgment and those Damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties afd it is Considered that the afd Charles Burges recover against the afd Edw.d Price his Damages afd to the afd Six hundred and fifty pounds of tobacco by the Same Edw.d in forme 239 afd Confessed as allso two hundred and thirty Nine pounds of tobacco for his Costs and Charges afd to the Said Charles at his request by the Court here and Consent of the parties afd adjudged and the afd Edw.d in Mercy |
