248 by him by Occasion of the premisses in that part sustained the Same Sidney Says and Confesseth that the aforesaid William has Sustained damages by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to twenty Six bushells of Indian Corn and noe more and becaus the aforesaid William Deny's not this but the Same allegation confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and charges aforesaid to him adjudged &c Therefore by consent of the parties aforesaid it is Considered that the aforesaid William Jones recover against the aforesaid Sidney Brown his damages aforesaid to the aforesaid twenty six bushells of Indian Corn by the Same Sidney in form aforesaid Confessed as also 3863 three hundred & Eighty three pounds of tobacco for his Costs and Charges aforesaid to the ^said^ W.m 383 at his request by the Court here and Consent of the parties aforesaid adjudged and ye afd Sidney in mercy &c
there to remain untill the Said Moses Chaille of the damages and Costs aforesaid should be fully Satisfied &c the Said sher to ^witt^ Joshua Caldwell Gent by John Dennis Jun.r his attorn deputy being present here in Court took Charge of the said Thomas Lord accordingly &c
Rachell Heatch and Ezekiel Heatch orphans of William Heatch dec.d in the full and Just Sum of One hundred and Nint thirty Nine pounds four shillings and two pence Currant Money to be paid unto the said William, John, Nehemiah Rachell and Ezekiel Heatch's their heirs Executors administrators or assignes to the which payment well and truely to be made and done we bind Our Selves our and Either of our heirs executors and adm.rs for the whole and in the whole Joyntly and Severally firmly by these presents sealled with our Seal and dated this 16.th day of August anno Dom 1732 The Condition of the above Obligation is such that whereas the Commisary Gen.ll hath transmitted into this Court the accompt of the estate of Wm Heatch dec.d wherein it is found that there is a ballance due to the above said Orphans the Sum of Sixty foure pounds twelve shillings and one penny If therefore the above said Rachell Heatch her heirs Executors or administrators shall and |
