one at Somerset County aforesaid was Indebted to the Said Will.m in the quantity
of thirty Bushells of indian Corn for divers good and Marchandizes to the Said
Sidney by the Said Will.m at the Speciall Instance and Request of him the Said
Sidney before that time sold and Delivered and being so thereof Indebted the
Said Sidney in Consideration thereof afterwards to witt the day and Year afd
at Somerset County aforesd and within the Jur of this Court upon himself
did assume and to the afd Will.m then and there faithfully promised
that he the Said Sidney the Said thirty Bushells of Indian Corn to the
Said Will.m when he Should be thereto Required well and faithfully over
wound Content and pay  Nevertheless the Said Sidney his promise and
assumption afd in forme afd Made no ways Regarding but disigning
and fraudulently Intending the Said Will.m in this part to deceive &
Defraud the Said thirty Bushells of Indian Corn or any part thereof to
the Said William hath not paid nor satisfied Altho this to do the Said
Sidney Afterwards to witt the Eighth day of June in the Year aforesd
at Somerset County afd by the Said W.m was required but the same
to him to pay or satisfy hither to altogether Refused and Still doth
refuse to the Damage of him the Said Will.m ten pounds Current Money
and thence he bringeth Suit &c                Pledges &c Jno Doe  R Roe

And the said Sidney Brown by Francis Allen his Attorney Cometh and
Defendeth the force and Injury when &c  And prays Leave thereof to Imparle
here untill the Next Court and he hath it and the same day is given to the
afd William here also &c       Att which Said Next Court to witt the
fifteenth day of August Ann Dom one thousand Seven hundred and
thirty two Came againe as well the afd Will.m Jones as the afd Sidney
Brown by their attorneys afd and thereupon the Said Sidney Brown
as before Defends the force and Injury when &c  And Saith that he did
not Assume upon himselfe in Manner and form as the Said Will.m
above against him hath Complained and of this he puts himselfe
upon the Country &c          Thereupon the afd Sidney Brown relinquisheth
his Verfiecation by him above protended and Says that
he Cannot gain say the action afd of the aforesd Will.m nor but that he
did assume upon himself in Manner and forme as the afd W.m above
against him Complained and as to the Damage of the Same Will.m
