same day is given to the aforesaid plft here also &c

       Att which said next Court to witt the fifteenth day of August Ann.o Dom One thousand seven hundred
and thirty two Came againe as well the aforesaid Henry Fitzwaters as the aforesaid Ambross Riggin
by their attorneys aforesaid and the aforesaid Henry Fitzwaters who offered the writt aforesaid against
the aforesaid Ambross Riggin Late of Somerset County planter in the aforesaid plea of trespass upon
the Case &c prosecutes not his writt aforesaid

       Therefore he and his pledges of prosecuting be in mercy and the plft mane his pledges &c and
that the aforesaid Ambross Riggin go thereof without day      Also it is Considered that the aforesaid
Ambross Riggin Recover against the aforesaid Henry Fitzwaters his damages by Occasion of the premisses
162   to One hundred & Sixty two                        pounds of tobacco to the same Ambross by discretion of
the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the
statute &c by the Court here adjudged &c

memorand.m the plft Sused Out his Lordships of attachment against the deft

the tenour whereof followeth in these words &c
Somerset ss  Charles absolute Lord and proprietary of the provinces of
Maryland and Avalon Lord baron of baltemore &c   To the Sher of Somrset
County greeting we Comand you that you Attach any the goods Chattells rights
and Creditts of Theophilus Dennis Late of Somrset County planter if they
shall be found in your bailywick and to the Value of one pound fourteen
Shillings Current Money and three hundred pounds of tobacco and when
you have the Same attached or any part thereof the Same in your
Custody Safe keep so that you have the Same before our Justices of our
County Court of Somerset to be held at Dividing Creek the third tuesday of
June Next then and there to be Condemned According to Act of Assembly
to and for the Use of a Certain Joshua Merrill Unless the Said Theophilus
Dennis by himself or his Attorney shall apear and answere unto the
Said Joshua Merrill in a plea of trespass upon the Case &c According to
Law and that by good and Lawfull men of your bailywick you make
known unto the Person or Persons in whose hands you make the
same attachment that he she or they be and appear before our Justices
of our County Court to be held as aforesd to shew Case if any he she or
they have why the Same goods Chattells Rights or Creditts so attached
in his her or their hands ought not to be Condemned and Execution
