244 assume upon himselfe in manner and form as the aforesaid John above against him hath declared and of this he puts himselfe upon the Country and the aforesaid plft Likewise Thereupon Command is given to the sher of Somerset County that Immediately he should cause to Come here in the Court aforesaid before the Justices ^thereof^ twelve &c by whom &c and who neither &c to recognize &c because as well &c and the Jurors of that Same Jury by the same sher to witt Joshua Caldwell Gent to this being Impannelled who were Called and did Come to witt William Jones Charles Racklife, Moses Duskey John Tull Thomas Hearn, Isaac Marshal Joseph Wait John Owten, Benjamin Tull William Smith George Maglamory and Richard Holland who to say the truth of and upon the premisses being elected tryed and Sworn upon their Oath did Say that the aforesaid Jarvice Ballard did not assume upon himselfe in manner and form as the aforesaid John Finch above against him hath Complained &c Therefore it is Considered that the aforesaid John Finch take nothing by his writt and declaration aforesaid but be in mercy for his falce Clamour and that the aforesaid Jarvice Ballard Goe thereof without day and further it is Considered by the Court here that the aforesaid Jarvice Ballard recover against the afd John Finch Nine hundred & seventy two 972 pounds of tobo for his Costs and Charges by him about his defence in that part Sustained to the same Jervice Ballard by the court here according to the form of the Statute in Such Case Lately made and provided adjudged and that the aforesaid Jervice have thereof Exn &c
Creek the third tuesday of March ^then^ next to answer unto Henry Fitzwaters of a plea of trespass upon the Case &c and that thereof her should not fail &c Att which said third tuesday of march to witt the twenty first day of the same month anno Dom One thousand Seven hundred and thirty One being the day of the return of the said writt Cometh the said Henry Fitzwaters by Levin Gale his attorney and the sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here endorsed vizt Cepi Corpus p Jos.a Caldwell sher And the aforesaid Ambross Riggin by George Douglass his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the same |
