243 afd Jarvis at the Especiall Instance and request of the Same Jarvis before that time there Sold and Delivered as by an account thereof here in Court Ready to be produced may appear and so thereof being Indebted the aforesd Jarvis afterwards to witt the Same ^tenth^ day of March in the Year aforesd at the county aforesd and within the Jur afd in Consideration thereof upon himself did asume and unto the afd John then and there faithfully did promise that he the afd twenty Seven pounds thirteen Shillings Current Money unto the Same John when thereof afterwards he Should be Required well and faithfully would pay and Content and Altho the afd Jarvis Eight pound fourteen Shillings and Six pence percell of the aforesd twenty seven pounds thirteen Shillings to the Same John he hath paid and Satisfied yett as to Eighteen pounds Eighteen Shillings and Six pence Current Money Residue of the aforesd Twenty Seven pounds thirteen Shillings Current Money the Said Jarvis his promise and assumption aforesd in forme aforesd made Little regarding but Minding & fraudulently Intending the Same John in this part Craftilly and Subtilly to deceive and Defraud the aforesd Eighteen pounds Eighteen Shillings and Six pence or any part thereof unto the Same John hath not paid or in any Sort Contented Altho to do the Same the aforesd Jarvis afterwards witt the Same day and year afd and often afterwards at the County afd within the Jur afd by the afd John was Requested but that unto him hitherto to pay or in any Sort to Content altogether hath Refused and Still doth refuse and to the Damage of the Said John of thirty Seven pounds Seventeen Shillings Like Money and there upon he bringeth Suit &c Pledges &c John Doe R Roe And the aforesd Jarvis Ballard by W.m Beckingham his Attorney Comes and Defends the force and Injury when &c and prays Leave thereof to Imparle here untill the Next Court and he hath it and the Same day is Given to the aforesd John here also &c Att which said next Court to witt the twentieth day of June Ann.o Dom One thousand seven hundred and thirty two Came againe as well the aforesaid John Finch as the aforesaid Jervice Ballard by their attorneys aforesaid and whereupon the Same Jervice prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the aforesaid John here also &c Att which said next Court to witt the fifteenth day of august anno Dom One thousand seven hundred & thirty two Came againe as well the aforesaid John Finch as the aforesaid Jervice Ballard by their attorneys afd and whereupon the Same Jarvis as before defends the force and Injury when &c and says that he did not assume |
