243 Says that he is not Informed by the Same Patrick of any answer for the same Patrick to the Same William and Thomas in the plea if as aforesaid to be Given nor nothing Else thereof says by which the same plfts Remaineth against the aforesaid defend.t thereof undefended Wherefore the aforesaid William and Thomas their damages ^by occasion of the premisses^ against the aforesaid Patrick Ought to recover Whereupon at the prayer of the afd William and Thomas and by the consent of the Same William and Thomas the Justices here according to act of assembly in Such Case made and provided assessed the damages of the same William and Thomas by occasion of the non performance of the promise and assumption aforesaid beyond the ^their^ Costs and Charges by them about their Suit in that part apposed to two pounds twelve shillings and Eleven pence halfe penny Currant money &c Therefore it is Considered by the Court here that the aforesaid William Kitchen and Thomas Gray recover against the aforesaid Patrick Burke their damages aforesaid to the aforesaid two pounds twelve shillings and eleven pence halfe penny Currant mony by the Justices afd in form aforesaid assessed as also two hundred & Ninty Five pounds of tobacco for 295 their Costs and Charges aforesaid to the same William and Thomas at their Request by the Court here adjudged & the afd deft in mercy &c memorandm the following bail peice should have been entered before the first Imparlence but was Omitted and entered here as followeth vizt Whereupon the said Patrick Burk being Called appears and thereupon the said Patrick Burke at the prayer of the Said William Kitchen and Thomas Gray is adjudged to Give speciall bail to the action aforesaid thereupon a Certain Dorman Heath of Somerset County planter present here in Court undertakes for the said Patrick Burke that if in Case the Said Wm and Thomas should recover Judgmt in the plea afd against the Said Patrick Burke or that the said Patrick Burk should be therein Convict that then he the Said Patrick Burke shall pay the Condemnation of the Court or render his body to the Custody of the sher of Somerset County in satisfaction thereof or that he the Same Dorman Heath will do the Same for him &c
Whereas the aforesd Jarvis the twenty Sixth day of March in the Year of our Lord God one thousand Seven hundred and thirty one at Somerset County Within the Jur of this Court was Indebted unto the aforesd John in the Sum of twenty Seven pounds thirteen Shillings Curr Money of Maryland for divers goods Wares and Marchandizes by the Same John unto the aforesd |
