242 Day of Decemb.r Ann.o Domini one thousand Seven hundred and thirty one at Somerset County within the Jur of this Court was Indebted unto the Same W.m and Thomas in two pounds twelve Shillings and Eleven pence halfe peny Current Money as by a Certain Note may more fully appear and so thereof being Indebted the Same Patrick afterwards to witt the Same day and Year afd at County aforesd and within the afd Jurisdiction In Consideration upon himself assumed and to the Said W.m and Thomas then and there faithfully did promise that he when afterwards he Should be thereto requested he the aforesd Sum of two pounds twelve Shillings and Eleven pence halfe peny Current Money to the Same W.m and Thomas well and faithfully would Content and pay Nevertheless the Said Patrick his Promise and Assumption aforesd In forme aforesd Made Little regarding but Plotting and fraudulently Intending them the Said W.m and Thomas In that part Craftilly and Subtilly to Defraud and Deceive he the Said Patrick the aforesd Sum of two pounds twelve Shillings and Eleven pence halfe penny nor any part thereof to the Same W.m and Thomas hath not paid or them for it in any wise Contented altho the Said Patrick the same to do afterwards to witt the same day and year afd at the County afd and within the aforesd Jurisdiction was Requested but the Same Patrick the Same to do hitherto hath Refused and Still doth Refuse whereby the same W.m and Thomas Saith they are worse and hath Damage to the Value of five pounds five Shillings and Eleven pence Like Money and thereof he brings this Suit &c Jno Doe Pledges &c R Roe And the aforesaid Patrick Burke by William Beckingham his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the aforesaid Wm & Thomas here also &c Att which said next Court to witt the twentyeth day of June anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid William Kitchen & Thomas Gray by their as the aforesaid Patrick Burke by their attorneys aforesaid and whereupon the same Patrick prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the aforesaid William & Thomas here also &c Att which said next Court to witt the fifteenth day of August anno Dom one thousand seven hundred and thirty two Came againe as well the aforesaid William Kitchen and Thomas Gray as the aforesd Patrick Burke by their attorneys aforesaid and the same Patrick by his said attorney as before d defended the force and Injury when &c and whereupon the same Wm and Thomas prays that the afd Patrick to ^their^ declaration aforesaid may answer upon that the aforesaid Attorney of the same Patrick says |
