242 Att which said Next Court to witt the twentieth day of June one thousand Ann.o Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesaid William Wye and Mary his wife by their attorneys aforesaid and ^thereupon^ the Said William Wye and Mary his wife pray further Leave thereof to Imparle here untill next Court and they have it and the Same day is Given to the aforesaid John here also &c Att which Said next Court to witt the fifteenth day day August Anno Dom one thousand Seven hundred and thirty two Came againe as well the aforesaid John Tunstall as the aforesd William Wye and Mary his wife by their attorneys aforesaid and whereupon the said W.m Wye and Mary his wife as before defends the force and Injury when &c and says the the aforesaid Spencer did not assume upon himselfe in manner and form as the aforesaid John above agt them hath Complained and thereof they putt themselves upon the Country and the ^afd^ plft Likewise Thereupon Command is Given to the sher of Somerset County that Immediately he should cause to Come here in the Court aforesaid before the Justices thereof twelve &c by whom &c and who neither &c to recognize &c because as well &c and the Jurors of that Same Jury by the Same sher to witt Joshua Caldwell Gent to this Impannelled being Called did Come (to witt) Charles Racklife, Moses Duskey, John Tull Senr Thomas Hearne, Isaac Marshall Joseph Waite John Owten, Benja Tull, Geo Maglamory Richard Holland Robert Mitchell and Joshua Merrill who to say the truth of and upon the premisses ^afd^ being elected tryed and Sworn upon their Oath did say that the aforesaid Spencer Hack in his Life did not assume ^upon himselfe in manner and form^ as the afd John Tunstall in manner and form above ^agt them^ hath Complained &c Therefore it is Considered that the aforesaid John Tunstall take nothing by his declaration aforesaid but be thereof in mercy for his falce Clamour and that the afd William Wye and Mary his wife admrx of the afd Spencer Hack goe thereof without day &c and further it is Considered by the Court that the afd William Wye and Mary his wife Recover against the afd John Tunstall 709 Seven hundred and Nine pounds of tobacco for their Costs and Charges by them about their defence in that part Sustained to the Same Wm Wye and Mary his wife by the Court here according to the form of the Statute in such Case Lately made and provided of their assent adjudged and that they have thereof Exn &c
