239 Caldwell and the Same Benj.a Holland Concerning the running of a Certain Bay ^Coloured^ horse of the Said Benj and the Running of a White or Gray Coloured horse of a Certain James Strawbridge on which Communication so had and Moved it was then and there agreed between the aforesd Joshua and the Same Benj in Manner and forme following Viz.t that he the afd Joshua Caldwell would Run or Cause to be run the afd horse of the Said James Strawbridge with the Said horse of the Same Benja the quarter of a Mile at the Race ground Near the Court house of the County aforesd on the Seventeenth day of Novemb.r Ann Dom Seventeen hundred and thirty one and that the Rider of the horses aforesd Should Ride the W^e^ight of one hundred and forty pounds Should start themselves and if both whipt it Should be a race and if the Said horse of the Said Strawbridge Should then and there pass by the Pole before the Said horse of the Same Benj then the Said Benj Assumed to pay to the Said Joshua the quantity of two thousand pounds of tobacco and if the Said Benj Said horse Should then and there pass by the pole before the Said horse of the Said Strawbridge then and the aforesaid Joshua assum'd to pay the Said Benj the Quantity of two thousand five hundred pounds of tobacco and thereupon the aforesd Joshua afterwards Vizt on the day and year aforesd at the place and within the Jur aforesd on Consideration of the premises and also on Consideration that the Same Benj Holland at the Especiall Request and Instance of the Said Joshua upon himself did assume and to the Same Joshua upon himself did Assume and to the Same Joshua then and there faithfully promise that he the aforesd Benj would runn or Cause to be run his horse aforesd the quarter of a Mile at the Race ground near the Court house of the County aforesd on the Seventeenth day of Nov.r Ann Dom Seventeen hundred and thirty one aforesd According to the tenor of the agreement aforesd and if ^the horse of^ the Said Strawbridge Should then and there pass by the Pole before the horse of the Said Benj ^that he the Same Benja^ would well and faithfully Content and pay to the Said Joshua the Quantity of two thousand pounds of tobacco when he Should be Afterwards thereto required by the Said Joshua upon himselfe did Assume and to the Same Benj then and there faithfully promise that he the Said Joshua Would Run or Cause to be run the horse afd of the Said Strawbridge with the horse of the Said Benj the quarter of a mile at the Race ground Near the Court house of the County afd on the Seventeenth day of Novemb.r Ann Dom Seventeen hundred ^&^ thirty one afd according to the tenor of ^the^ agreement aforesd and |
