and if the Said horse of the Said Benj Should then and there pass by
the pole before the Said Horse of the Said Strawbridge that he the said
Joshua Would well and faithfully Content and pay to the Said Benj
the Quantity of two thousand five hundred pounds of tobacco when
he Should be afterwards thereto Required by the Said Benj and
the aforesaid Benj in fact Saith that on the day and year last
Mentioned the Said horse of him the Said Benj and the Said
Strawbridge did Run together the Quarter of a Mile at the afd
Race ground Near the Court house of the County aforesd that the Riders
of both the horses aforesd did Ride the Weight of one hundred and forty
pounds did start themselves and both whipt and that the Said horse
of the Said Benj passed by the Pole before the Said horse of the afd
Strawbridge   Nevertheless the aforesd Joshua his promise and
assumption aforesd in Manner and forme aforesd Made Little
Regarding but Minding and fraudulently Intending the aforesd
Benjamin in that part Craftilly and Subtilly to deceive and Defraud
the aforesd Quantity of two thousand five hundred pounds of tobacco to
the aforesd Benj hath not paid altho the Same to pay afterwards
to witt the Same day and Year afd at Somerset aforesd within the aforesd
Jur the afd Joshua by the the Said Benj was Required but the same
Quantity of two thousand five hundred pounds of tobacco to the Same
Benj hitherto to pay hath altogether Refused and Still doth rufuse
to the Damage of the Same Benj five thousand pounds of tobacco and
thereof he brings Suit &c                                    Jno Doe

And the aforesaid Joshua by Francis Allen his attorney Comes and defends the force and Injury
when &c and prays Leave ^thereof^ to Imparle here untill next Court and he hath it and the Same day
is Given to the aforesaid Benjamin here also &c

       Att which said next Court to witt the twentieth day of June anno Dom One thousand Seven
hundred and thirty two Came againe as well the aforesaid Benjamin as the aforesaid Joshua
by ^their attorneys afd and^ thereupon the Said Joshua prays further Leave thereof to Imparle here untill next
Court and he hath it and the Same day is Given to the aforesaid Benjamin here also &c

             Att which said next Court to witt the fifteenth day of August anno Dom One thousand
Seven hundred and thirty two Came againe as well the aforesaid Benjamin Holland as the
aforesaid Joshua Caldwell by their attorneys aforesaid and where^upon^ the Said Joshua as before
defends the force and Injury when &c and Says that he did not assume upon himselfe in
                                                                                                                      manner
