August Court               1732                           239

Ann.o Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid Caleb Harris
as the afd Patrick Daley by their attorneys aforesaid and whereupon the Same Patrick as before defends
the force and Injury when &c and saith that of the premisses aforesaid above Imposed upon him
is not Guilty in manner and form as the said Caleb against him hath Complained and of this he
putts himselfe upon the Country         and the plft Likewise

       Thereupon Command was Given to the sher of Somerset County that Immediately he Cause
to Come here twelve &c by whom &c and who neither &c to recognize &c because as well &c of which
said preceipt the Said sher to witt Joshua Caldwell Gent now hereat this day to witt the Same day &
Year Last mentioned Came and made return that he hath here ready twelve &c as by his Said preceipt
he was Commanded and now hereafterwards to witt the Same day and Year Came as well the
afd plft as the aforesd deft by their attorneys afd and the Jurors of that Jury by the sher being
Impannelled were Called Came to witt William Jonas Charles Rackliffe Moses Duskey John
Tull Thomas Hearn Isaac Marshall Joseph Waite John Owten Benjamin Tull William
Smith George Maglamory and Richard Holland who to say the truth in the premisses being
duely elected tryed and sworn upon their Oath did say that the aforesaid Patrick Daley is not
Guilty of the premisses as the aforesaid Caleb Harris in manner and form above against him hath
Complained
                               Therefore it is Considered that the aforesaid Caleb Harris take nothing
by his declaration aforesaid but for his falce Clamour be thereof in mercy and that the aforesaid
Patrick Daley Goe thereof without day &c    and further it is Considered by the Court that the aforesd
Patrick Daley Recover against the aforesaid Caleb Harris Eight hundred & Eighty five
885   pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to
the Same Patrick Daley by the Court here according to the form of the Statute in such Case
Lately made and provided of his assent adjudged and that the afd Patrick Daley have thereof
Execution &c

Gent was Attached to answere unto Benj Holland of
a plea of trespass upon the Case &c              And Whereupon
the Same Benj by George Doughlis his attorney
       Complains that Whereas on the fifth day of October Ann Dom Seventeen
       hundred and thirty one at Somerset afd  Within the Jur of this Court
       a Certain Communication had and Moved between the Said Joshua
                                                                                                    Caldwell
